新政下企业劳务派遣工同工同酬问题的探讨

【摘要】：自20世纪90年代以来,作为市场经济产物的劳务派遣制已成为国内企业越来越普遍的用工方式。劳务派遣制也是目前发展较快、问题较多的一种用工形式,《劳动合同法》中先后拟定相关条款规范完善该制度,特别是2014年3月1日开始实施的《劳务派遣暂行规定》对该制度更是作了进一步的规范,但劳务派遣工待遇差异即同工不同酬的问题还是客观存在的。纵观目前劳务派遣工收入待遇差异的种种现象,本文认为要改观这种不公正待遇,还需要从观念认知上、执法力度上、用工企业用人策略上以及劳务派遣工自身素质提升等方面来加强改善,通过各方的努力,以期达到缩小收入待遇差异、公平对待劳务派遣工的目的。
[Abstract]:Since 1990's, labor dispatch system, as the product of market economy, has become more and more common in domestic enterprises. The labor dispatch system is also a form of employment with rapid development and more problems at present. In the Labor contract Law, the relevant provisions have been formulated to standardize and perfect the system. In particular, the interim regulations on Labor dispatch, which began on March 1, 2014, have further standardized the system, but the difference in the treatment of labor dispatch workers, that is, the problem of unequal pay for work of equal value, still exists objectively. Looking at the various phenomena of the difference in income and treatment of labor dispatch workers at present, this paper holds that in order to improve this unfair treatment, it is also necessary to understand the concept and enforce the law. In the employment strategy of employment enterprises and the improvement of the quality of labor dispatchers themselves, through the efforts of all parties, in order to reduce the difference in income and treatment, fair treatment of labor dispatchers.
