事业单位人事聘用制改革背景下的聘用合同相关法律问题研究

【摘要】:本文结合目前事业单位正在进行的改革实践,采用了规范研究和实证研究相结合的方法,从对我国实施聘用合同制度改革的法律演进分析入手,对聘用合同制度作全方位,深入的研究。 本文首先探讨事业单位聘用合同制度的现状、实施难点,并对规范合同订立给出几点建议,如:注意合同期限、规范条款约定、谨慎变更合同等。 同时针对聘用合同签订、实施、解除过程中出现的人事争议问题,探讨了目前的几种救济途径,同时分析了救济途径中存在的部分问题,如:使用法律不够完善、人事争议仲裁受案范围小、裁审衔接不到位等问题,提出了解决争议几种的几种构想。 最后,针对聘用合同与劳动合同的关系分析,对聘用合同法律适用进行了定位,即同时适用《劳动合同法》和相关人事管理规定。 论文结尾,探讨了聘用制改革的发展趋势,指出聘用合同最终将与劳动合同趋同,统一由《劳动合同法》进行调整的观点。
[Abstract]:Based on the current reform practice of public institutions, this paper adopts the method of combining normative research and empirical research, starting with the analysis of the legal evolution of the reform of employment contract system in China, and makes an all-round and in-depth study on the employment contract system. This paper first discusses the present situation and implementation difficulties of the employment contract system in public institutions, and gives some suggestions for standardizing the conclusion of the contract, such as paying attention to the duration of the contract, standardizing the terms and conditions, carefully changing the contract, and so on. At the same time, in view of the personnel disputes in the process of signing, implementing and terminating the employment contract, this paper probes into several kinds of relief ways at present, and analyzes on some problems existing in the relief ways, such as: the use of the law is not perfect, the scope of arbitration of personnel disputes is small, and the connection of adjudication is not in place, etc., and several ideas for resolving disputes are put forward. Finally, according to the analysis of the relationship between employment contract and labor contract, the application of employment contract law is defined, that is, the labor contract law and related personnel management regulations are applied at the same time. At the end of the paper, this paper probes into the development trend of the reform of employment system, and points out that the employment contract will eventually converge with the labor contract and unify the viewpoint that the employment contract will be adjusted by the Labor contract Law.
