从功能翻译理论的角度看合同翻译

　　自从上世纪中叶功能理论诞生并被引入翻译理论研究以来,翻译理论在有了长足的发展。无论是以奈达和纽马克为代表的功能对等理论,还是以赖斯,弗米尔为代表的功能学派提出的目的论,连贯性法则,“功能加忠诚”原则,至今都在翻译讨论中占据相当重要的地位,并产生了深远的影响。国内的学者也对此作过大量深入的研究,但这些研究主要集中在文学翻译领域,如诗歌翻译,小说翻译等等,而及法律英语翻译,尤其是合同翻译的研究却非常少。为此,本文力图将功能学派理论和合同翻译实践相结合,一方面从功能学派理论出发,为合同翻译制定原则,另一方面和笔者的翻译实践相结合,从下向上地提出一些合同翻译的策略,力求从微观角度为体现这些原则提供方法和路径。本文的第一章综合介绍了合同翻译,对合同翻译做了定义和分类,还对国内对合同翻译现有的研究状况做了综述。第二章首先以奈达的功能对等理论将开去,重点介绍了目前功能学派的主要理论,然后将功能学派理论和合同翻译相结合,分析并提出了合同翻译的四大原则,第三章从实践的角度出发,力求从翻译实践角度实践合同翻译的四大原则,为此,笔者首先从词,句,和语义的角度分析了法律合同的语言特征,然后有针对性地提出了一些...
