对解除非法同居关系的案件必须以判决形式结案的质疑

【摘要】：正 1989年底,最高人民法院颁布实施的《关于人民法院审理未办理结婚登记而以夫妻名义同居生活案件的若干意见》。意见的第7条规定:“未办结婚登记而以夫妻名义同居生活的男女,一方要求“离婚”或解除同居关系,经查确属非法同居关系的,应一律判决予以解除。”笔者认为,对非法同居关系必须一律予以解除,但不一定非要
[Abstract]:At the end of 1989, the Supreme people's Court promulgated some opinions on the trial of cases of cohabitation in the name of husband and wife by the people's Court. Article 7 of the opinion states: "A man or woman who has not registered a marriage and cohabited in the name of a husband and wife, if one of the parties requests' divorce'or the dissolution of a cohabitation relationship, if it is found to be illegal, shall give the same decision." The author believes that the illegal cohabitation relationship must all be dissolved, but it does not have to be necessary.
