论网络购物的格式条款

【摘要】:如今的时代是互联网的时代,“互联网+”模式遍布我们日常生活的每一个角落,其中网络购物更是成为人们日常生活中不可或缺的一部分。网络购物的便捷性和高效性给购物者带来了极大的愉悦购物体验。网络购物经营者为了缩短购物周期,提高购物效率,常常使用大量的格式条款来订立合同。由于网络环境的虚拟性,消费者在网上购物时容易忽视格式条款的存在,或者限于网页的局限不注意阅读格式条款。同时网络购物的经营者为了规避自己的义务会不提供格式条款、不对格式条款进行合理提示或者在格式条款中加入有利于自己的免责条款等。这些都使得网络购物的消费者的合法权益尤其是在发生纠纷时受到极大的威胁。我国法律对于网络购物格式条款的规制并不明确,因网络购物格式条款发生的纠纷屡见不鲜。本文首先对网络购物的特点、网络购物中格式条款的特点进行总结,厘清网络购物格式条款与一般格式条款的区别。其次,探寻网络购物格式条款的生效要件,网络购物格式条款的生效要件比一般格式条款更为严格,其中网络购物经营者的合理提示义务和解释说明义务更重,格式条款需购物者接受才可生效,且必须不属于不寻常条款。再次,对网络购物格式条款的解释的特殊性进行讨论,网络购物格式条款的解释要求客观解释大于主观解释,且对于社会效应的要求更高,更加注重对消费者的保护。最后,提出完善网络购物格式条款制度的方法,包括扩大撤销权范围、加强监管等措施。
[Abstract]:Today's era is the era of the Internet, "Internet" model throughout our daily life every corner. Among them, online shopping has become an indispensable part of people's daily life. The convenience and efficiency of online shopping bring shoppers a great pleasure shopping experience. Online shopping operators in order to shorten the shopping cycle. . To improve shopping efficiency, a large number of format clauses are often used to conclude contracts. Because of the virtual nature of the network environment, consumers tend to ignore the existence of format clauses when shopping online. Or limited to the limitations of the web page do not pay attention to the terms of the format. At the same time online shopping operators in order to avoid their obligations will not provide format terms. Do not carry on the reasonable prompt to the form clause or add the exemption clause in favor of oneself in the format clause etc. These make the legal rights and interests of the consumer of the network shopping especially be subjected to the great threat in the time of the dispute. The regulation of online shopping format provisions is not clear in Chinese law. Because of the online shopping format clause disputes are common. Firstly, this paper summarizes the characteristics of online shopping format clauses. Clarify the difference between the online shopping format clause and the general format clause. Secondly, explore the effective elements of the online shopping format clause, the effective elements of the online shopping format clause is more strict than the general format clause. Among them, the obligation of reasonable prompt and explanation of the online shopping operator is more important, the format clause can only be accepted by the shopper, and it must not be an unusual clause. Again. This paper discusses the particularity of the interpretation of the online shopping format clause. The interpretation of the online shopping format clause requires more objective interpretation than subjective interpretation, and the demand for social effects is higher. Finally, it puts forward the methods of perfecting the system of online shopping format clauses, including expanding the scope of revocation rights, strengthening supervision and other measures.
