韩国循环经济法律制度对我国的借鉴研究

【摘要】：我国社会经济快速发展,现行的循环经济法律制度已经不能适应社会发展需要。我国循环经济法律制度主要涉及循环经济政策、三原则和基本管理制度等,缺乏与《循环经济促进法》配套的相关法律法规,难以将法律实施,这也阻碍了循环经济的发展。循环经济法律法规之间有很多交叉冲突的地方,制定的法律没有收到良好的实施效果,构建科学全面的循环经济法律制度是当务之急。韩国循环经济法律制度经过50多年的发展,循环经济法律制度建设取得了显著成就。笔者利用在韩国仁荷大学交换学习的机会,充分利用学校资源收集韩国循环经济法律制度的研究资料撰写此文。全文采用文献研究法和比较研究法,介绍了中韩循环经济法律制度的发展现状,通过分析中国循环经济法的立法缺陷和韩国循环经济法律制度的先进经验得出对我国循环经济发展获得了有意义的借鉴经验,笔者认为我国从立法、司法和执法三方面完善我国循环经济法律制度。立法方面,提出制定《循环经济法》和《环境教育法》、完善生产者责任延伸制度;司法方面,提出完善环境公益诉讼制度和多元环境纠纷解决制度;执法方面,提出强化公众参与、明确执法主体和政府严格执法。在可持续发展的理念下逐步完善循环经济法律制度,推进循环经济法律体系发展。党十八大报告提出生态文明建设循环经济,循环经济是符合生态文明建设的一种新经济发展模式,建设生态文明国家最终实现建设美丽中国的愿景。党十八大报告提出依法治国,使国家事务有法可依。法制是具有稳定性、前瞻性、强制性,是稳健的制度形式。完善循环经济法制建立《循环经济法》,运用法治方式发展循环经济,将循环经济推向新发展阶段,促进社会经济可持续发展。
[Abstract]:With the rapid development of China's social economy, the current legal system of circular economy can no longer meet the needs of social development. The legal system of circular economy in China mainly involves circular economy policy, three principles and basic management system, etc. The lack of relevant laws and regulations in conjunction with the Circular economy Promotion Law makes it difficult to enforce the law, which also hinders the development of circular economy. There are many overlapping conflicts between laws and regulations on circular economy. The laws formulated have not received good implementation results. It is imperative to build a scientific and comprehensive legal system for circular economy. After more than 50 years of development, the legal system of circular economy in South Korea has developed. Significant achievements have been made in the construction of the legal system of circular economy. This article is written with the full use of school resources to collect the research materials on the legal system of circular economy in Korea. This paper introduces the current situation of the development of the legal system of circular economy in China and Korea by using the method of literature research and comparative research. By analyzing the legislative defects of China's circular economy law and the advanced experience of Korea's circular economy legal system, the author draws a meaningful reference experience for the development of China's circular economy. In the aspect of legislation, it is proposed to formulate the Circular Economic Law and the Environmental Education Law, to perfect the extended system of producer responsibility, to improve the judicial aspect, to improve the legal system of circular economy in China from the three aspects of the administration of justice and the law enforcement of the law. In the aspect of law enforcement, we should strengthen public participation, clarify the subject of law enforcement and the government's strict enforcement of the law, and gradually improve the legal system of circular economy under the concept of sustainable development. Promoting the development of the legal system of circular economy. The report of the 18 National Congress of the Communist Party of China proposed that ecological civilization should be built in a circular economy, and that circular economy is a new economic development model in line with the construction of ecological civilization. Building an ecological civilized country will ultimately realize the vision of building a beautiful China. The legal system is stable, forward-looking, and mandatory. Perfecting the legal system of circular economy, establishing the law of circular economy, using the rule of law to develop the circular economy, pushing the circular economy to a new stage of development, and promoting the sustainable development of social economy.
