童星的民事法律保护研究

【摘要】：童星作为娱乐圈中的未成年人群体,其利益经常受到雇主、新闻媒体及其监护人的侵害。在人身利益方面,通过实行工作许可制和小时制,可以保障他们身体健康权;确立儿童利益最大化原则及限制新闻媒体与表达自由,可以有效保护他们的隐私权。在财产利益方面,通过设立相应信托账户并明确童星本人为其财产唯一所有权人,可以保证他们的获得报酬权;而合同解除权的赋予也使他们能够更好地防范监护人侵害,维护自己的自由意志。
[Abstract]:As a group of minors in the entertainment circle, child stars are often infringed by their employers, the news media and their guardians. In terms of personal interests, the right to physical health can be guaranteed through the implementation of the work permit system and the hourly system; Establishing the principle of maximizing the interests of children and restricting the media and freedom of expression can effectively protect their right to privacy... with regard to property interests, by establishing a corresponding trust account and making clear that the child star himself is the sole owner of his property, It can guarantee their right to receive remuneration, and the right to rescind the contract also enables them to guard against the infringement of their guardians and to safeguard their free will.
