工程法学体系构建研究

【摘要】：工程法学的体系构建研究,属于经济法学关注的范畴。在我国,工程法律规范体系客观存在。这种不争的事实,为探讨、构建和完善具有中国特色的工程法学体系,奠定了社会基础。开展工程法学的研究,分析工程法律规范的运用,对于较准确地把握我国工程法律法规的现状,梳理我国工程社会关系中的法律关系调整问题,发现其规律性,形成其工程法学理论,构建其符合工程社会关系的法学体系,具有主要意义。开展工程法学理论探索,形成合理完善的工程法学体系,有利于促进我国工程法学的健康发展。本文从经济法学的视角出发,以探索构建工程法学框架体系为目标,借助我国经济法特别是产业法的研究方法、逻辑框架和建构体系,综合运用理论推理、概念分析、实证研究等方法,从我国现行的工程法律法规运用中,发现法律运用问题,总结工程法学的法学规律。本文在广泛搜集资料和系统分析的基础上,通过分析工程规划、建设、监管等工程环节中的法律运用,从工程法学理论和工程法律制度两个层面,厘清我国由法律调整的各种工程法律关系,以形成我国工程法学体系的构建思路,提出我国工程法学的思路与框架。通过开展工程法学体系构建探索,初步总结出如下结论:我国工程法学是我国经济法体系的重要组成部分,是经济法中宏观调控法一个分支。通过对我国工程法律法规进行梳理,初步提出了工程法学研究的理论脉络,从构建全面、完整、系统、协调的工程法律制度体系的思路出发,提出了构建工程法学的进一步设想。
[Abstract]:The system construction of engineering law belongs to the category of economic law. In China, the system of engineering legal norms exists objectively. This indisputable fact lays a social foundation for exploring, constructing and perfecting the engineering law system with Chinese characteristics. To carry out the research of engineering law, to analyze the application of engineering laws and regulations, to grasp accurately the present situation of engineering laws and regulations in our country, to sort out the adjustment of legal relations in the social relations of engineering in our country, and to find its regularity. It is of great significance to form the theory of engineering law and to construct a legal system which accords with the social relations of engineering. Developing the theoretical exploration of engineering jurisprudence and forming a reasonable and perfect engineering jurisprudence system will help to promote the healthy development of engineering jurisprudence in China. From the perspective of economic law, this paper aims at exploring and constructing the frame system of engineering jurisprudence, with the help of the research methods, logical framework and construction system of economic law, especially industrial law, and synthetically applying theoretical reasoning and conceptual analysis. From the current application of engineering laws and regulations in China, the author finds out the problems in the application of law and summarizes the law law of engineering law. Based on the extensive collection of data and systematic analysis, this paper analyzes the application of law in engineering planning, construction, supervision and other engineering links, from the two aspects of engineering law theory and engineering legal system. This paper clarifies various kinds of engineering legal relations adjusted by law in our country, in order to form the train of thought of construction of engineering law system of our country, and puts forward the train of thought and frame of engineering law of our country. By exploring the construction of engineering law system, the following conclusions are drawn: engineering law in China is an important part of economic law system and a branch of macro-control law in economic law. By combing the laws and regulations of engineering in our country, this paper puts forward the theoretical context of the study of engineering law, starting from the idea of constructing a comprehensive, complete, systematic and coordinated legal system of engineering. The further assumption of construction of engineering law is put forward.
