互助旅游法律问题分析

【摘要】：我国旅游产业日趋发展,在旅游业迅猛发展促进区域和全国发展的情况下也出现了许多亟待法律法规规制的现象,经国家旅游局与多部门合作、共同努力,于2013年10月1日正式颁布实施《中华人民共和国旅游法》,该法的颁布实施意义重大,我国旅游业的整体现状得以改变,对旅游经营者和旅游者产生了极大的影响,真正改变了过去旅行社宰客,旅游者有苦难言,投诉又无法可依的状态,对于我国旅游行业的发展具有划时代的意义。然而即使如此,《中华人民共和国旅游法》仍然存在许多瑕疵,譬如旅游法只是对团队旅游做出了规定,里面涵盖了在团队旅游过程中,旅游经营者、旅游者以及其他旅游参与者的权利和义务,而关于互助旅游方面的法律条文,却没有直接提到。由于互助旅游在我国还是一种新型的旅游方式,没有法律法规和政策的规制,在互助游的过程中双方的权益就很难得到保证。基于上述思考,从以下几个方面探讨笔者对国内互助旅游中出现的法律问题,以期寻求解决该类问题的途径。全文共分为四个部分。第一部分,互助旅游法律问题的研究意义,主要从互助旅游的相关概念、含义、类型和历史由来等方面进行论述,提出研究互助旅游法律问题的理论意义和实践意义。第二部分,互助旅游相关的理论概述,主要分析互助旅游中各方参与者的主体身份介绍和身份界定、互助旅游主体的法律特征,互助旅游主体的内部法律关系和外部法律关系、以及互助旅游法律责任的分析。第三部分,通过互助旅游的几个案例对互助旅游实践中的问题进行分析。第四部分,通过第三部分中提到的实践中存在的问题提出完善互助旅游的法律对策和建议。
[Abstract]:The tourism industry of our country is developing day by day. With the rapid development of tourism industry and the promotion of regional and national development, there are many phenomena that need to be regulated by laws and regulations. The "Tourism Law of the people's Republic of China" was promulgated and implemented on October 1, 2013. The promulgation and implementation of this law is of great significance, and the overall situation of tourism in China has been changed, which has had a great impact on tourism operators and tourists. It is of epoch-making significance to the development of tourism industry in our country. However, even so, the Tourism Law of the people's Republic of China still has many flaws. For example, the Tourism Law only provides for team tourism, which covers tour operators in the process of team tourism. The rights and obligations of tourists and other tourist participants are not directly mentioned in the legal provisions on mutual tourism. Since mutual aid tourism is still a new type of tourism in our country, it is difficult to guarantee the rights and interests of both sides in the process of mutual aid tourism without the regulation of laws, regulations and policies. Based on the above thinking, the author discusses the legal problems in the domestic mutual aid tourism from the following aspects, in order to find a way to solve this kind of problems. The full text is divided into four parts. The first part, the research significance of mutual aid tourism legal issues, mainly from the related concepts, meaning, types and historical origin of mutual aid tourism, and put forward the theoretical and practical significance of the study of mutual aid tourism legal issues. The second part, the related theories of mutual assistance tourism, mainly analyzes the main body identity introduction and definition of participants in mutual aid tourism, the legal characteristics of mutual aid tourism subject, the internal legal relationship and external legal relationship of mutual aid tourism subject. And mutual aid tourism legal liability analysis. The third part analyzes the problems in the practice of mutual-aid tourism through several cases of mutual-aid tourism. The fourth part, through the problems in practice mentioned in the third part, put forward the legal countermeasures and suggestions to perfect mutual aid tourism.
