我国空难理赔体系完善构想——以马航MH370事件为视角

【摘要】：马航MH370失联事件已经过去整整两年,然而家属索赔依旧处于争议和模糊的状态。如何建立中国国情下的空难理赔体系,完善现有索赔程序的不足,从而与法制发达国家接轨,是我国现阶段空难理赔所关注的重点。本文以马航MH370事件为切入点,通过中外空难理赔制度的对比,分析我国现有空难理赔体系的缺点,并提出了完善方略和建立构想。
[Abstract]:Exactly two years have passed since the disappearance of Malaysia Airlines MH370, but family claims remain controversial and vague. How to set up the air accident claim system under the national conditions of China, perfect the deficiency of the existing claim procedure, so as to connect with the developed country of legal system, is the focus of our country's air accident claim settlement at the present stage. Based on the MH370 incident of Malaysia Airlines, this paper analyzes the shortcomings of the existing air accident claim system in China through the comparison between the Chinese and foreign air accident claim systems, and puts forward the improvement strategy and the establishment idea.
