复杂金融衍生品侵权诉讼应实行举证责任倒置

【摘要】：复杂金融衍生品交易存在着信息严重不对称、双方交易地位不平等、信息披露不充分、滥用格式条款、风险提示不充分等问题。在复杂金融衍生品侵权诉讼中,"谁主张谁举证"的举证责任顺置对投资者来说有失公平。为此,应当对金融机构实行举证责任倒置,这有助于利用诉讼程序法更为有效地保护投资者的实体权利,强化金融机构的信息披露责任,防范金融机构侵权行为的发生。
[Abstract]:There are some problems in complex financial derivatives trading, such as serious information asymmetry, unequal trading position, inadequate disclosure of information, abuse of format clauses, inadequate risk hints, etc. In the complex financial derivative tort lawsuit, the burden of proof is unfair to investors. Therefore, the burden of proof should be reversed to the financial institutions, which is helpful to protect the entity rights of investors more effectively by using the procedural law, to strengthen the responsibility of information disclosure of financial institutions, and to prevent the occurrence of infringing acts of financial institutions.
