国内商业保理风险及其法律规制研究

【摘要】：国内保理业务在我国经济快速增长的宏观环境下,近年来得到了快速的发展。但国内保理业务目前为止仍以银行作保理商的占绝大部分业务量。本文所研究的主要对象是以国内非银行机构作为国内保理商的国内保理业务,即称国内商业保理。通过对国内商业保理的法律性质、法律基础、法律环境以及当事人权利义务关系的分析,重点揭示了该项业务的法律风险和操作风险等风险状况,并为此尝试性地提出了不断完善我国相关法律法规和建立监管体系、加强行业监督等一系列思路,推进国内商业保理业务健康、稳健发展。
[Abstract]:The domestic factoring business has developed rapidly in recent years under the macro environment of rapid economic growth in China. But the domestic factoring business so far still take the bank as the factor account for most of the business. The main research object of this paper is domestic factoring business, which is called domestic commercial factoring. Based on the analysis of the legal nature, legal basis, legal environment and the relationship between the rights and obligations of the parties, the legal risk and operational risk of the business are revealed. In order to promote the healthy and steady development of domestic commercial factoring business, this paper tries to improve the relevant laws and regulations of our country, establish the supervision system, strengthen the supervision of the industry, and so on.
