【摘要】: 作为一种新型用工方式,劳务派遣改变了传统劳动关系中用人单位与劳动者之间的法律地位,使被派遣劳动者受到派遣单位与用工单位的双重约束,但其作为劳动者的基本权利却在这种复杂的关系中得不到应有的保护。劳务派遣立法的相对滞后和缺失、制度的不完善,是被派遣劳动者劳动权得不到保障的主要原因。因此,本文从分析劳务派遣法律关系的性质入手,并在借鉴世界各国关于被派遣劳动者劳动权保护的相关法律制度基础上,总结了目前我国劳务派遣中存在的妨害被派遣劳动者劳动权实现的主要问题及对现行立法的相关规定进行了检讨,提出了对我国劳务派遣立法规制的总体构想和具体制度设计,以期被派遣劳动者的劳动权得到有效的保护,促进劳务派遣的良性发展以及劳动关系的和谐。
[Abstract]:As a new mode of employment, labor dispatch has changed the legal status between employers and workers in the traditional labor relations, so that dispatched workers are subject to the dual constraints of dispatch units and employment units. But its basic rights as a laborer can not be protected properly in this complicated relationship, the relative lag and lack of labor dispatch legislation, the imperfect system. It is the main reason that the labor rights of dispatched workers can not be guaranteed. Therefore, this paper starts with the analysis of the nature of the legal relationship of labor dispatch. And on the basis of drawing lessons from the countries in the world on the protection of the labor rights of dispatched workers on the basis of the relevant legal system. This paper summarizes the main problems that hinder the realization of the labor rights of dispatched workers in China and reviews the relevant provisions of the current legislation. This paper puts forward the general conception and concrete system design of legislation regulation of labor dispatch in our country in order to protect the labor rights of dispatched workers effectively and promote the benign development of labor dispatch and the harmony of labor relations.
