【摘要】：本文以家政工应有的权利极其救济程序的优化设置为目的,在对国内外研究现状进行了深入分析的基础上,对家政工的各项权利极其在各国的实现情况和家政工权利保障的救济程序进行了研究。首先,从家政工的概念和分类开始,介绍了不同国家对家政工的理解和家政工的分类情况,在分析了家政工所包含的范围和家政工的分类以及家政工目前的发展状况及其面临的困境之后,重点分析了造成这种状况的原因。其次,在分析家政工发展所面临的困境之后,论述了家政工应当享有的权利,包括联合国《经济、社会、文化权利国际公约》、《世界人权宣言》和《公民权利与政治权利国际公约》中所规定的家政工作为劳动者所应当享有的不被强迫或强制劳动、合格的工作条件、集会和结社自由等各种权利以及家政工作为公民应当享有的禁止家庭暴力、迁徙自由、隐私保护和言论自由等不同权利。在介绍完家政工应当享有的权利之后,重点介绍了家政工在美国法律中的地位,包括在联邦层次上的《国家劳动关系法》、《职业安全和医疗护理法》、《民权法》、《公平劳动标准法》和不同州的法律对家政工权利保护的不同规定。另外。由于美国是英美法系国家,案例在其司法判决中具有重要意义,基于此本文还重点介绍了关于家政工司法判决的判例。在介绍完美国家政工的现状之后,分析了其他国家关于家政工权利的保护情况。最后,结合我国的具体情况,借鉴世界其他国家的先进经验和国际公约的规定,探讨了我国家政工保护的具体方法和救济程序的优化设置。这部分分析了我国现行法律对于家政工的态度,在此基础上提出了我国家政工权利的保护方式和实现方法。
[Abstract]:In order to optimize the domestic workers' rights and relief procedures, this paper makes a thorough analysis of the current research situation at home and abroad. This paper studies the rights of domestic workers and their realization in different countries and the remedy procedure of guaranteeing the rights of domestic workers. First of all, starting with the concept and classification of domestic workers, this paper introduces the understanding of domestic workers and the classification of domestic workers in different countries. After analyzing the scope of domestic workers and the classification of domestic workers as well as the current development situation of domestic workers and the difficulties they face, this paper focuses on the reasons for this situation. Secondly, after analyzing the difficulties faced by political workers, they discussed the rights that domestic workers should enjoy, including the United Nations [Economic, Social, Domestic work, as provided for in the International Covenant on Cultural Rights, the Universal Declaration of Human Rights and the International Covenant on Civil and political Rights, is a condition of work that is not subject to forced or compulsory labour and is eligible for work by workers, The rights to freedom of assembly and association and domestic work are different rights for citizens, such as the prohibition of domestic violence, freedom of movement, privacy protection and freedom of expression. After introducing the rights that domestic workers should enjoy, they focused on the status of domestic workers in United States law. Including the National Labor Relations Act at the federal level, the Occupational Safety and Medical Care Act, the Civil Rights Act, the Fair Labor Standards Act and the different provisions of the laws of different states on the protection of the rights of domestic workers. In addition, since the United States is a common law country, The case is of great significance in its judicial decision. Based on this, this paper also focuses on the case law of domestic workers. After introducing the current situation of political workers in perfect countries, this paper analyzes the protection of the rights of domestic workers in other countries. Finally, taking into account the specific conditions of our country and drawing on the advanced experience of other countries in the world and the provisions of international conventions, This part analyzes the attitude of our country's current law to domestic workers, and puts forward the way to protect and realize the rights of our country's political workers.
