外国人在华就业管理法律制度研究

【摘要】:外国人就业作为劳动行为的一种,其劳动关系的发生受内国政策因素影响较大。就主权国家而言,往往只在特定领域允许外国人就业,并规定严格准入条件。一旦违反该类有关准入的限制性规定,即可被认定为非法就业。在我国,外国人非法就业行为是指外国人违反就业管理法规,未持有外国人就业证和外国人居留证件,在中国境内从事社会劳动并获取报酬的行为。外国人非法就业问题,也就是通常意义上的非法劳工问题。 对外国人非法就业进行法律规制有着现实必要性与紧迫性。世界各国普遍建立了较为完善的外国人就业管理法律制度对国内外国劳工就业进行规范,根据不同的移民管理制度,国内学者将外国人就业区分为职业移民与国际劳工。职业移民多为移民国家所采用。作为非移民国家,我国现行外国人就业管理制度体系并不完善,仅仅对国际劳工中具有专业技术外国人员的劳动就业进行规范,即便中国式“绿卡”制度也采取有条件地实行从国际劳工向永久居留资格转变的方式。外国人就业管理制度理应与移民取向相并行,但现行管理制度并不符合我国发展现状,构建新型管理制度势在必行。 本篇论文主要分为四个部分。 第一章论述了外国人在华就业的基本问题,指出外国人非法就业是非法移民过程的一项环节,对外国人在华就业状况、特征和非法就业的危害进行阐述,并结合我国国情,分析外国人非法就业的成因,指出进一步规范和完善我国外国人就业管理制度的必要性和紧迫性。 第二章对外国人就业的法律规制进行剖析,从外国人就业法律规制的法理基础,包括就业权及其限制理论和国际法依据、外国人就业管制国内一般法律制度及俄罗斯和德国管制外国人就业的实践等三方面进行了论述,以期为我国相关制度立法指明方向。 第三章介绍了中国现行的外国人就业管理制度,首先是我国确立外国人就业管理制度的四项基本原则,其次是针对该事项的具体法律规定,最后发现现行制度中主要存在问题,为下文针对性地提出解决方案做理论铺垫。 第四章从构建我国新型外国人就业管理立法出发,汲取德国、俄罗斯两国的外国人就业管理制度经验,为我国确立制度准则提供参考,继而在立法措施、运行机制、调控手段等方面对就业管理制度予以完善。
[Abstract]:As a kind of labor behavior, the employment of foreigners is greatly influenced by the domestic policy factors. In the case of sovereign countries, foreigners are often allowed to obtain employment only in specific fields. In our country, illegal employment of foreigners refers to the violation of employment regulations by foreigners. The act of engaging in social work and obtaining remuneration in China without holding an employment permit or residence permit for foreigners. The illegal employment of foreigners is the problem of illegal labor in the ordinary sense. It is necessary and urgent to regulate the illegal employment of foreigners. The countries all over the world have established a relatively perfect legal system of employment management of foreigners to regulate the employment of domestic and foreign workers. According to different immigration management systems, domestic scholars divide the employment of foreigners into professional migrants and international workers. Most of them are adopted by immigration countries. As a non-immigrant country, the current employment management system of foreigners in China is not perfect. To regulate only the employment of foreign workers with professional skills in the international labour force, Even though the "green card" system of Chinese style also adopts the mode of conditional transformation from international labor to permanent residence qualification, the employment management system for foreigners should be parallel to the orientation of immigration, but the current management system does not conform to the present situation of China's development. It is imperative to construct a new management system. This paper is divided into four parts. The first chapter discusses the basic problems of the employment of foreigners in China, points out that illegal employment of foreigners is a link in the process of illegal immigration, expounds the employment status, characteristics and harm of illegal employment of foreigners in China, and combines the national conditions of our country. This paper analyzes the causes of illegal employment of foreigners, and points out the necessity and urgency of further standardizing and perfecting the employment management system of foreigners in China. The second chapter analyzes the legal regulation of the employment of foreigners, from the legal basis of the legal regulation of the employment of foreigners, including the right to employment and its restriction theory and the basis of international law. This paper discusses the general domestic legal system of the control of foreigners' employment and the practice of controlling the employment of foreigners in Russia and Germany in order to point out the direction of the relevant system legislation of our country. The third chapter introduces the current employment management system of foreigners in China. Firstly, it introduces the four basic principles of establishing the employment management system for foreigners in China, and secondly, it introduces the specific legal provisions on this matter. Finally, the main problems in the current system are found, which pave the way for the following solutions. The 4th chapter starts from the construction of the new foreign employment management legislation in our country, draws on the experience of the foreign employment management system of Germany and Russia, and provides reference for establishing the system standard of our country, and then in the legislative measures, the operation mechanism, Control means and other aspects to improve the employment management system.
