我国劳动争议处理程序问题研究

【摘要】: 在企业关系和劳动关系日趋多样化的今天,劳动争议日益引起人们的关注,如何有效地化解劳动关系矛盾,及时有效地解决劳动争议,对平衡劳资力量、促进劳动关系的和谐发展,将起到关键的作用。本文通过剖析现行劳动争议处理程序存在的以下问题:调解组织缺乏追求公信力、公正性与工作效率的激励机制和动因约束;调解程序为非必经程序,影响了调解作用的发挥;劳动争议调解协议执行力得不到法律支持;仲裁机构半官方性质和仲裁员指定制度降低了当事人对仲裁的信任度;劳动争议仲裁裁决缺乏独立性和权威性;劳动争议仲裁前置有悖于公正和效率;劳动争议诉讼管辖的规定不尽合理;诉讼程序救济缺失;“裁审”适用法律的不一致性等。然后提出以下设想:把设在企业内部的调解组织转化为企业外部的调解组织;建立区域性和行业性劳动争议调解组织;建立与实施争议调解结果的强制执行程序;仲裁机构实体化,进一步完善“三方原则”;建立有效的劳动争议仲裁监督制度;劳动争议仲裁应实行“或裁或审”。通过以上设想,以寻求快速解决劳动争议的方式,建立行之有效的劳动争议处理程序,健全并完善监督体制,并最终达到及时、有效地解决劳动争议,建立和谐的社会关系的目的。
[Abstract]:In today's increasingly diversified enterprise and labor relations, people are increasingly concerned about labor disputes. How to effectively resolve labor relations contradictions, resolve labor disputes in a timely and effective manner, and balance labor forces, To promote the harmonious development of labor relations will play a key role. This paper analyzes the following problems existing in the current labor dispute handling procedures: mediation organizations lack of credibility, fairness and work efficiency incentive mechanism and motivation constraints; Mediation procedure is a non-necessary procedure, which affects the exertion of mediation function; the execution of labor dispute mediation agreement cannot be supported by law; the semi-official nature of arbitration institution and the appointment system of arbitrators reduce the parties' confidence in arbitration; The arbitration award of labor dispute lacks independence and authority; the leading position of labor dispute arbitration is contrary to justice and efficiency; Lack of relief in litigation procedure, inconsistency of applicable law in "adjudication", etc. Then the following assumptions are put forward: transforming the mediation organization located inside the enterprise into the mediation organization outside the enterprise, establishing regional and professional labor dispute mediation organization; Establish and implement the procedure of enforcing the outcome of dispute mediation; materialize the arbitration institution, further improve the Tripartite principles; establish an effective supervisory system for labor dispute arbitration; and implement "or adjudication or adjudication" in labor dispute arbitration. In order to find the way to solve the labor dispute quickly, to establish the effective labor dispute handling procedure, to perfect and perfect the supervision system, and finally to solve the labor dispute in time and effectively, and to establish the harmonious social relationship.
