劳务派遣工社会保险权益研究

【摘要】:劳务派遣是一种源于欧美、上世纪九十年代开始活跃于我国的用工模式,它是区别于传统直接雇工的一种间接雇工模式,是一种适应现代市场经济的灵活就业形式。改革开放后我国开始了劳务派遣的用工模式,二十一世纪,中国的劳务派遣进入了快速发展轨道,专门从事劳务派遣中介的机构不断增多,通过劳务派遣机构就业的人员数量也在大规模递增。 劳务派遣工的社会保险权益维护较为困难,这不只是由于劳务派遣存在三方法律关系主体,而且由于这一用工模式导致了雇佣和使用相分离,加上我国的劳务派遣工人大多工作流动性比较大,难以在某一固定区域缴纳社会保险,用工单位不直接兑现工人的工资和支付相关待遇,用工单位和派遣单位在工人社会保险权益方面的责任存在一定的推诿现象,遇到社会保险权益的争议时,往往牵扯较多,利益关系复杂。同时,由于劳务派遣工人大多来自农村,在农村参加了农村合作医疗保险,而我国的各种社会保险与工人的户籍挂钩,很多劳务派遣工人对于各种社会保险法规不了解,无法利用已有的法律法规保护自身的利益。 文章阐释了劳务派遣中蕴涵的法律关系,梳理了劳务派遣工社会保险的法理基础,简要概括了我国劳务派遣工的相关社会保障政策发展历程。分析劳务派遣工的社会保险存在的问题及原因,探讨了劳务派遣关系中的雇主责任的法律规制形式,并且对我国劳务派遣工社会保险的责任主体进行了较深入的分析。在劳务派遣用工关系中,劳务派遣单位才是法律意义上的雇主,是真正的劳动法意义上的用人单位,因此应该承担对于工人的雇主责任,用人单位对于劳动者造成相应损害的,派遣单位和用人单位都应承担连带赔偿责任。最后对劳务派遣用工形式中的社会保险存在的问题的对策与建议。本文认为,要切实完善针对劳务派遣工群体的社会保险法制工作,同时要整合全国的社会保险征收机构,大大提升社会保险的统筹层次,最终实现我国模式统一、覆盖城乡的全国统筹的社会保险体系,完善劳务派遣工社会保险专门的转移接续机制,在社会制度方面配合劳务派遣工人社会保险权益的保护。
[Abstract]:Labor dispatch is a kind of employment mode, which originated from Europe and America. In -10s, it is active in our country. It is a kind of indirect employment mode, which is different from traditional direct employment. It is a flexible form of employment adapted to the modern market economy. After the reform and opening up, China began the employment mode of labor dispatch. In 21th century, China's labor dispatch entered the track of rapid development. Agencies specializing in labor dispatch agencies are increasing, and the number of people employed through labor dispatch agencies is also increasing on a large scale. It is difficult to maintain the social insurance rights and interests of labor dispatch workers, which is not only due to the existence of tripartite legal relations in labor dispatch, but also to the separation of employment and use due to the employment mode. In addition, most of the labor dispatch workers in our country have relatively large job mobility, so it is difficult to pay social insurance in a certain fixed area, and employers do not directly cash in workers' wages and pay related treatment. There is a phenomenon of prevarication in the responsibilities of employment units and dispatch units in respect of workers' social insurance rights and interests. When they encounter disputes over social insurance rights and interests, they often involve more and have complex interests. At the same time, Since most of the labor dispatch workers come from rural areas and participate in rural cooperative medical insurance, and the various social insurance in our country are linked to the household registration of workers, many of the labor dispatch workers do not know about various social insurance laws and regulations. It is impossible to use existing laws and regulations to protect one's own interests. The article explains the legal relationship in labor dispatch, combs the legal basis of social insurance of labor dispatch. This paper briefly summarizes the development course of social security policy of labor dispatch workers in China, analyzes the problems and causes of social insurance of labor dispatch workers, and probes into the legal regulation forms of employer responsibility in the labor dispatch relationship. In the labor dispatch employment relationship, the labor dispatch unit is the employer in the legal sense and the employer in the true labor law sense. Therefore, the employer should bear the responsibility for the worker, and the employing unit will cause corresponding damage to the worker, The dispatch unit and the employing unit should both bear joint and several liability for compensation. Finally, the countermeasures and suggestions on the problems existing in social insurance in the form of labor dispatch are put forward. It is necessary to improve the legal system of social insurance for labor dispatch groups, at the same time, to integrate the national social insurance collection institutions, to greatly enhance the overall level of social insurance, and finally to realize the unification of our country's model. A nationwide overall social insurance system covering urban and rural areas, a special transfer mechanism for social insurance for labor dispatch workers, and cooperation in the social system to protect the social insurance rights and interests of labor dispatch workers.
