完善我国妇女平等就业权法律保障之探讨

【摘要】： 平等就业权对于女性而言具有重要意义。作为人权的内容之一,它关系到妇女的独立生存和发展。建国以后,我国也制定了一些保护妇女就业权的法律。但由于我国长期实行行政主导就业,导致在妇女平等就业权方面缺乏深入研究。在计划经济向市场经济的转型过程中,对妇女的就业歧视问题逐渐暴露出来。这些歧视不仅表现在就业机会方面,还表现在培训、工资待遇、职位晋升等各个环节。造成这些问题有多种原因,但首先就是有关法律制度的不完善。本文首先对妇女平等就业权加以阐述,然后第二部分通过详实案例和大量数据资料,展示我国妇女在就业领域受到的歧视与侵害,并对其原因和危害进行分析。第三部分主要介绍发达工业化国家和我国香港、台湾地区的相关立法及对我们的启示。第四部分提出完善相关法律制度的建议。第五部分作出结论。
[Abstract]:The equal right to employment is of great significance to women. As one of the contents of human rights, it relates to the independent survival and development of women. China has also enacted some laws to protect women's right to employment. However, due to the long-term implementation of executive-led employment in China, there is a lack of in-depth research on women's equal employment rights. In the process of transition from planned economy to market economy, The problem of discrimination against women in employment is gradually exposed. These discrimination are manifested not only in employment opportunities, but also in training, wage treatment, job promotion and so on. There are many reasons for these problems. But the first is the imperfect legal system. The second part shows the discrimination and violation of women in the field of employment through detailed cases and a lot of data. The third part mainly introduces the developed industrialized countries and Hong Kong, China. The relevant legislation of Taiwan area and its enlightenment to us. Part 4th puts forward the suggestion of perfecting the relevant legal system. 5th part draws the conclusion.
