我国过劳死法律规制存在的问题与对策研究

【摘要】：随着中国经济的发展和世界经济全球化的影响,劳动形态越来越复杂多元,过劳死悲剧频现报端。2015年3月12日新闻媒体报道富士康因违法加班致员工过劳死,劳动者痛失生命和健康的严酷事实引发人们对过劳死的思考。无论在哪个国家,确保劳动者良好的劳动条件和雇用安定,倡导劳动者身心健康的劳动方式,尊重劳动者的人格与自由,实现劳动者体面的有尊严的劳动,既是社会发展与进步的必然要求,也是劳动法的灵魂与价值所在。目前我国过劳死在法律上处于盲区,如何在发展社会经济的同时,避免或减少伤亡事故,给予劳动者更好的劳动保护,是企业、政府、国家所致力解决的,也是值得学者深思的问题。本文作者建议把过劳死法定为工伤范畴,过劳死现象的蔓延对社会的负面价值非常大,因此对过劳死进行法律规制是刻不容缓。本文基本内容为:引言部分主要是讲述现如今我国过劳死的研究现状和社会现状;第一部分主要是阐述何为过劳死;第二部分主要是阐述为什么要对过劳死进行法律规制,只有将过劳死问题尽快进行法律规制,劳动者的权益才能够最大的得到救济;第三部分讲述过劳死相关的法律现状及其存在的问题,为解决过劳死入法提出建议;第四部分讲述了如何对过劳死进行法律规制,借鉴日本、美国和我国台湾地区的经验,对我国过劳死的法律规制提出建议,以期对过劳死问题的解决有所帮助。
[Abstract]:With the development of China's economy and the impact of the globalization of the world economy, labor patterns are becoming more and more complex and diversified. In March 12th 2015, the news media reported that Foxconn died of overwork because of illegal overtime work. The harsh fact that workers have lost their lives and health has caused people to think about overwork. In any country, it is necessary to ensure good working conditions and employment stability, and to promote the working methods of workers' physical and mental health. Respecting the personality and freedom of the laborer and realizing the decent and dignified work of the laborer is not only the inevitable requirement of the social development and progress, but also the soul and value of the labor law. At present, the death of overwork in our country is in the blind zone of the law. How to avoid or reduce casualties while developing social economy and to give workers better labor protection is a problem that enterprises, governments, and the state are committed to solving. It is also a question worth pondering by scholars. The author of this paper suggests that the death of overwork should be defined as a category of industrial injuries, and that the spread of the phenomenon of overwork is of great negative value to society. Therefore, it is urgent to regulate the death of overwork by law. The basic contents of this paper are as follows: the introduction is mainly about the current research and social status of overwork death in our country, the first part is mainly about what is the death of overwork; The second part is to explain why the legal regulation of overwork death, only the problem of overwork death as soon as possible legal regulation, workers' rights and interests can be the greatest relief; The third part describes the current legal situation and existing problems of overwork death, and puts forward some suggestions to solve the problem of overwork death law. Part 4th describes how to regulate overwork death by law, and draw lessons from the experiences of Japan, the United States and Taiwan. In order to solve the problem of overwork death, some suggestions are put forward on the legal regulation of overwork death in China.
