转型时期集体谈判核心地位研究

【摘要】:当前,我国正处在体制改革、结构调整与社会历史性变革的转型时期。市场化的劳动关系已基本形成并逐步占据了主导地位。但在实践中,适应市场化劳动关系的调节机制和制度还很不完善。建立有效的劳动关系调整机制是完善市场经济体制的必然要求。 本文主要采用了规范的分析方法对观点进行了阐述。本文以转型时期劳动的社会性质的变化为立论基础,以市场经济条件下企业制度安排中的产权、劳权关系为主线,结合文献研究、访谈调查、比较分析等方法进行深入分析,提出了在我国转型时期“集体谈判在调整劳动关系制度中应居于核心地位”的观点。笔者认为这对于建立和谐的劳动关系是具有理论和现实意义的。 在提出问题、界定概念并分析了国内外相关研究现状后,笔者就集体谈判在西方主要市场经济国家的发展,给予的启示及我国集体谈判现状进行了分析。然后,笔者重点论述了现代劳动关系调整机制必须改变的直接基础,市场经济下的企业制度安排以及现代劳动关系法律调整对集体谈判核心地位的要求,确立集体谈判核心地位的意义等问题。最后,笔者对适用于中国的劳动关系模式、集体谈判与其它调整劳动关系机制功能的比较进行了阐述。
[Abstract]:At present, our country is in the transition period of system reform, structural adjustment and social historic change.Market-oriented labor relations have basically formed and gradually occupied a leading position.However, in practice, the adjustment mechanism and system to adapt to market labor relations is still very imperfect.The establishment of an effective labor relationship adjustment mechanism is the inevitable requirement of perfecting the market economy system.This article mainly uses the standard analysis method to expound the viewpoint.Based on the change of the social nature of labor in the transitional period, this paper takes the property right and labor right relation in the arrangement of the enterprise system under the market economy as the main line, combines the literature research, the interview investigation, the comparative analysis and so on, carries on the thorough analysis.This paper puts forward the view that collective bargaining should occupy the core position in the adjustment of labor relation system in the period of transition of our country.The author believes that this is of theoretical and practical significance for the establishment of harmonious labor relations.After putting forward the questions, defining the concept and analyzing the current situation of the research at home and abroad, the author analyzes the development of collective bargaining in the major market economy countries in the West, the enlightenment it gives and the present situation of collective bargaining in China.Then, the author focuses on the direct basis of the adjustment mechanism of modern labor relations, the arrangement of the enterprise system under the market economy and the requirements of the legal adjustment of the modern labor relations on the core position of collective bargaining.The significance of establishing the core position of collective bargaining.Finally, the author expounds the comparison of the functions of labor relations model, collective bargaining and other adjustment mechanisms in China.
