待命时间的劳动法问题研究

【摘要】:待命时间广泛存在于现如今的劳动过程中,由其引发的劳动纠纷也不胜其数。我国法律法规并没有针对待命时间的明确规定,司法实践中对待命时间的处理千差万别,学理上同样研究较少难以提供足够的理论支撑。如果待命时间不能合理认定无疑会损害劳动者的合法权益,从而不利于平衡劳雇关系、稳定劳动秩序,因此对于待命时间的认定进行研究实属必要。本文在综合现有学说的基础上对劳动者的工作时间、休息时间重新进行厘清,进而明确待命时间的内涵与特征。认为待命时间是劳动者在雇佣者的指挥命令下,保持随时准备提供劳务、完成工作任务状态的时间。待命时间在许多域外国家已有不少先进经验,笔者梳理相关研究成果和司法判例,总结影响待命时间认定的因素。通过分析影响待命时间认定的四大因素,提出待命时间的认定原则:以劳动合同和法律规定为依托,以雇佣者的指挥命令为前提,结合待命地点、劳动强度、劳动密度等具体因素进行综合判断。并从准备和收尾工作、监视性工作、断续性工作、候传性工作等类型,结合具体案例对待命时间进行具体认定。最后从完善特殊工时制度和发挥工会谈判协商力量两个方面,试着提出待命时间问题的解决之策。通过以上的研究,形成对待命时间法律问题全面深入的认识,以期为学理和实务中解决待命时间有关问题提供一个思考方向。
[Abstract]:Standby time widely exists in today's labor process, by which labor disputes are numerous.China's laws and regulations do not have a clear provision for standby time, judicial practice of standby time treatment is very different, the same little theoretical research is difficult to provide sufficient theoretical support.If the standby time can not be reasonably determined, it will undoubtedly damage the legitimate rights and interests of workers, which is not conducive to the balance of labor and employment relations, stability of labor order, so it is necessary to study the determination of standby time.On the basis of synthesizing the existing theories, this paper clarifies the working time and rest time of workers, and then clarifies the connotation and characteristics of standby time.It is believed that standby time is the time when the laborer, under the command of the employer, is ready to provide labor and complete the task.Standby time has a lot of advanced experience in many foreign countries. The author combs the relevant research results and judicial precedents and summarizes the factors that affect the determination of standby time.Based on the analysis of the four factors affecting the determination of standby time, the principle of determining standby time is put forward: relying on the labor contract and legal provisions, taking the command and order of the employer as the premise, combining with the standby place, the labor intensity,Labor density and other specific factors for comprehensive judgment.And from the preparation and closing work, monitoring work, intermittent work, and other types of work, combined with specific cases to determine the standby time.Finally, from two aspects of perfecting the system of special working hours and exerting the negotiation power of trade union, the author tries to put forward the solution to the problem of standby time.Through the above research, a comprehensive and in-depth understanding of the legal issues of standby time is formed in order to provide a thinking direction for solving the problems related to standby time in theory and practice.
