企业社会责任实践中农民工劳动权益保护问题之研究

【摘要】： 近年来,我国企业尤其是中小企业中大量的一线职工为外来农民工,尽管他们整体的文化素质较低,但已成为国内企业一线用工的主要来源。而农民工在企业的生存和工作状况却不尽如意。一些企业因盲目追求利润而忽视了其应负的社会责任,出现了众多的劳资纠纷、拖欠工资、恣意延长劳动时间,频发人为安全事故等等问题,这些触目惊心的事件频频发生,使人们对“企业社会责任”、提高企业“公民”责任的呼声日益高涨。本文旨在企业社会责任的理论指导下,采用因果分析的思路,对企业社会责任理论进行阐释,着重从企业社会责任体系中员工保护、生产安全、职业健康、保护劳动者的合法权益这一视角,结合我国企业农民工劳动权益缺失的现状,加以剖析,探究其发生的主要原因。在此基础上结合我国实际,提出三方面对策思路。第一,从完善企业组织管理入手,通过规范企业治理结构,强化企业诚信理念,提升企业经营管理者素质,组建包括农民工在内的工会组织,优化企业人力资源管理,切实维护农民工劳动权益。第二,从强化政府职责出发,通过完善并落实《公司法》、《劳动法》及相关法律法规,完善社会保障体系,加强劳动监督与公共服务体系建设,强化农民工劳动权益保障的政府与法律支持。第三,从创新社会认证与审计体系出发,创设经营者职业资格认证制度和企业履行社会责任审计制度,全方位落实保护农民工劳动权益社会体系。通过上述三个方面的组织与制度建设,完善维护农民工劳动权益的管理体系,推动企业全面、自觉地履行社会责任。
[Abstract]:In recent years, a large number of front-line workers in Chinese enterprises, especially in small and medium-sized enterprises, are migrant workers. Although their overall cultural quality is relatively low, they have become the main source of front-line employment in domestic enterprises. However, the survival and working conditions of migrant workers in enterprises are not satisfactory. Some enterprises have ignored their social responsibilities because of their blind pursuit of profits, resulting in numerous labor disputes, wage arrears, arbitrary extension of working hours, frequent man-made safety accidents, and so on. These shocking incidents occur frequently. Make people to "corporate social responsibility", enhance enterprise "citizen" responsibility voice is rising day by day. Under the guidance of the theory of corporate social responsibility, this paper uses the idea of causality analysis to explain the theory of corporate social responsibility, focusing on employee protection, production safety and occupational health in the system of corporate social responsibility. From the perspective of protecting the legitimate rights and interests of laborers, this paper analyzes the present situation of the lack of labor rights and interests of migrant workers in Chinese enterprises, and probes into the main causes of their occurrence. On this basis, combined with the reality of our country, three countermeasures are put forward. First, starting with the improvement of enterprise organization and management, by standardizing the corporate governance structure, strengthening the concept of enterprise integrity, improving the quality of enterprise managers, setting up trade union organizations, including migrant workers, and optimizing the management of enterprise human resources, We will earnestly safeguard the labor rights and interests of migrant workers. Second, starting from the strengthening of government responsibilities, we should improve the social security system and strengthen the labor supervision and public service system by perfecting and implementing the Company Law, the Labor Law, and relevant laws and regulations. Strengthen the protection of migrant workers' labor rights and interests of the government and legal support. Thirdly, starting from the innovation of social certification and auditing system, we should create the system of professional qualification certification for operators and the audit system for enterprises to fulfill social responsibility, and implement the social system to protect the labor rights and interests of migrant workers in all directions. Through the above three aspects of organization and system construction, improve the management system to safeguard the labor rights and interests of migrant workers, and promote the enterprises to fulfill their social responsibilities comprehensively and consciously.
