职场性骚扰的法律规制研究

【摘要】:职场性骚扰问题是现今世界各国普遍存在的社会问题。从我国的情况来看,随着人们权利意识的提高,职场性骚扰问题逐渐成为人们关注的话题。近年来,发生职场性骚扰的案件越来越多,得到社会各界的广泛讨论与关注。然而,由于我国相关立法在规定职场性骚扰方面存在不完善的问题,审判实践中法官面临着对待职场性骚扰问题时认识不一、法律适用标准难以统一等难题。为了解决职场性骚扰问题,为审判实践提供更充足的理论支持,我们应该在认清国情的情况下,积极借鉴外国先进立法经验,加快立法步伐,丰富我国相关法律,努力保护受害者的利益,以便能够有效地维护正常的职场秩序和社会的和谐稳定,促进社会良好和谐发展。本文正是从这一视角出发,试图通过对职场性骚扰的若干问题规制研究,并对此问题提出一些完善的建议,以期望对此类案件的处理提供一点有用意见。 本文除前言、结语外共分为以下四个部分: 第一部分是问题的提出。本部分主要简单介绍一个案例,并对案例引发的问题进行梳理。主要涉及的问题是:规制职场性骚扰的必要性是什么?职场性骚扰如何界定?职场性骚扰的责任承担者是谁? 第二部分是规制职场性骚扰的必要性。这部分主要从三个方面来说明规制职场性骚扰的必要性和现实意义。 第三部分是职场性骚扰的概念界定。这部分首先从四个方面进行分析,以期说明职场性骚扰的概念,然后分析职场性骚扰的法律特征。最后对职场性骚扰进行分类,目的是为了下面部分找到我国解决职场性骚扰问题的方法。 第四部分是职场性骚扰的法律责任。本部分是该论文的重点,针对案例所反映的问题来分析和解决。其基本结构是首先明确职场性骚扰行为人的责任承担以及责任承担方式,然后介绍国内外关于雇主责任的相关立法情况,找出适合建立中国国情的雇主责任的方法,为了更好的保护受害者,对我国的建立雇主责任提出一些建议。
[Abstract]:Workplace sexual harassment is a common social problem all over the world. From the point of view of our country, with the improvement of people's awareness of rights, the issue of sexual harassment in the workplace has gradually become a topic of concern. In recent years, there are more and more cases of sexual harassment in the workplace. However, due to the imperfect regulation of workplace sexual harassment in the relevant legislation of our country, judges are faced with different understanding of the issue of sexual harassment in the workplace in trial practice and difficult to unify the applicable standards of the law. In order to solve the problem of sexual harassment in the workplace and provide more adequate theoretical support for the trial practice, we should actively learn from the advanced legislative experience of foreign countries and enrich the relevant laws of our country under the condition of clearly understanding the national conditions. Efforts to protect the interests of victims, in order to effectively maintain normal workplace order and social harmony and stability, promote social harmony and development. From this point of view, this paper attempts to study some problems of sexual harassment in the workplace, and puts forward some perfect suggestions in order to provide some useful suggestions on how to deal with such cases. In addition to the preface, the conclusion is divided into the following four parts: The first part is the proposal of the problem. This part mainly introduces a case and combs the problems caused by the case. The main questions involved are: what is the necessity of regulating sexual harassment in the workplace? What is the definition of sexual harassment in the workplace? Who is responsible for sexual harassment in the workplace? The second part is the necessity of regulating sexual harassment in the workplace. This part mainly from three aspects to explain the necessity and practical significance of regulation of sexual harassment in the workplace. The third part is the definition of workplace sexual harassment. This part first analyzes the concept of workplace sexual harassment from four aspects, and then analyzes the legal characteristics of workplace sexual harassment. Finally, the classification of workplace sexual harassment, the purpose is to find a solution to the problem of workplace sexual harassment in the following part. The fourth part is the legal liability of sexual harassment in the workplace. This part is the focus of this paper, to analyze and solve the problems reflected in the case. The basic structure is to first clarify the responsibility of the perpetrators of sexual harassment in the workplace and the way to assume the responsibility, and then introduce the relevant legislation on employer liability at home and abroad, and find out the appropriate ways to establish the employer liability in China. In order to better protect the victims, some suggestions on establishing employer responsibility in our country are put forward.
