劳动者忠实义务研究

【摘要】:劳动者与用人单位之间的相互信赖是维系和谐劳动关系的基础。就劳动者而言,善尽忠实义务是其获得用人单位信任的关键。劳动者忠实义务是以维护用人单位合法利益为目标,基于诚实信用原则以及劳动关系的继续性、从属性特征而对用人单位履行的以服从、告知、保密、竞业限制等为基本内容的各项作为义务与不作为义务的总称。忠实义务兼具伦理性特质与社会法属性。在现代劳动关系背景下,忠实义务建立在劳动者的独立人格之上,劳资双方不再是主仆身份关系,因此忠实义务不能无限扩大而成为用人单位限制劳动者追求个人合法权益的枷锁。为发挥劳动者忠实义务的积极作用,在维护用人单位合法利益的同时兼顾劳动者以及其他主体的利益,对劳动者忠实义务的程度及行为标准进行合理的考量便显得尤为重要,考量的因素应包括不同层次劳动者的差异性、忠实义务是否及于劳动者的职务外行为、劳动者的重大法益以及社会公共利益等内容。追究劳动者违反忠实义务的法律责任时应考虑劳资双方强弱势力量的对比而限制当事人之间的契约自由并采取过错责任原则。劳动者违反忠实义务主要承担用人单位惩戒与损害赔偿责任。基于劳动者的弱势地位与倾斜保护劳动者的价值取向,当前立法的关注点主要集中于劳动者的权利方面,对劳动者义务的规定存在不足之处,有必要对劳动者忠实义务的基本内容、考量因素、违反该义务所承担的法律后果等方面予以完善。
[Abstract]:The mutual trust between laborer and employer is the basis of maintaining harmonious labor relationship. As far as the laborer is concerned, it is the key to obtain the trust of the employer to fulfill the duty of loyalty. The duty of loyalty of the laborer is to safeguard the legitimate interests of the employing unit, based on the principle of good faith and the continuation of the labor relations, according to the characteristics of the attributes of the unit of choose and employ persons to comply with, inform, keep secret, The general term of obligation of action and obligation of omission, which is the basic content of the restriction of competition. The duty of loyalty has both ethical characteristics and social law attributes. Under the background of modern labor relations, the duty of loyalty is based on the independent personality of the laborer. Therefore, the duty of loyalty can not be expanded infinitely and become the shackles of employers to restrict workers from pursuing their legitimate rights and interests. In order to give full play to the positive role of laborer's duty of loyalty, it is particularly important to take into account the interests of workers and other subjects while safeguarding the legitimate interests of the employer, so it is particularly important to take reasonable account of the degree of the duty of loyalty and the standard of conduct of the laborer. The factors to be considered should include the differences of workers at different levels, whether the duty of loyalty is due to the outside behavior of workers, the major legal interests of workers and the public interests of society and so on. When investigating the legal liability of workers for violating the duty of loyalty, we should consider the contrast between the strong and weak forces of labor and management, and restrict the freedom of contract between the parties and adopt the principle of fault liability. The laborer violates the faithful duty mainly to undertake the unit of choose and employ persons discipline and the damage compensation responsibility. Based on the weak position of the laborer and the value orientation of protecting the laborer, the focus of the current legislation is mainly on the rights of the laborer, and the stipulation of the laborer's obligation has some shortcomings. It is necessary to perfect the basic contents, factors and the legal consequences of violation of the duty of loyalty.
