我国运动员劳动权法律保障研究

【摘要】：随着市场经济的发展,我国的法治建设也在加快进行。然而,运动员——竞技体育的参与者、推动者,他们赖以生存和发展的劳动权,却在法律上难以得到根本的保障。这不仅导致了许多侵害运动员劳动权利的个案发生,同时也阻碍了我国竞技体育事业的蓬勃发展。体育事业的发展与法治建设滞后之间的矛盾,造成了许多运动员劳动报酬得不到有效保障,社会保险也不健全,纠纷解决机制难以畅通,运动员的合法权益得不到有效的救济。运动员作为一类特殊的劳动者,有其特有的劳动权特征。这使得现行《劳动法》在很多条款上的规定,都不能适应运动员劳动权的保障。因此,这就需要我们从实际出发,结合运动员的特点,提出具体有效的解决办法和措施。文章主要从以下四个部分展开:第一部分主要介绍劳动权的概念以及运动员劳动权利的特征;第二部分主要从运动员劳动权在实践中受到侵害的现象出发,分析其受到侵害的原因;第三部分分析域外运动员劳动权利保护的先进做法,有哪些值得我们借鉴和学习的地方;第四部分主要是从立法、执法以及司法救济等方面,提出一些对运动员劳动权益保护的可行性建议。笔者希望通过对这一问题的研究,能唤起社会各界对运动员这一特殊群体劳动权保护的重视,并能探索出一条切实可行的保障之路,以期更好的规制体育行业,并对运动员劳动权的保护有所帮助。
[Abstract]:With the development of market economy, the construction of rule of law in our country is also speeding up. However, athletes, participants and promoters of competitive sports, the labor rights they rely on for survival and development, are difficult to obtain the fundamental protection in law. This not only led to many cases of violation of athletes' labor rights, but also hindered the vigorous development of competitive sports in China. The contradiction between the development of sports cause and the construction of rule of law has resulted in the lack of effective protection of the labor reward of many athletes, the unsound social insurance, the difficulty of the dispute resolution mechanism, and the lack of effective relief for the legitimate rights and interests of the athletes. As a special kind of laborer, athletes have their own characteristics of labor rights. This makes the current labor law in many provisions, can not adapt to the protection of athletes' labor rights. Therefore, we need to start from the reality, combined with the characteristics of athletes, put forward specific and effective solutions and measures. The article mainly starts from the following four parts: the first part mainly introduces the concept of the labor right and the characteristics of the athletes' labor rights, the second part mainly starts from the phenomenon that the athletes' labor rights are infringed in practice. The third part analyzes the advanced practices of protecting the labor rights of athletes in foreign countries, which are worthy of our reference and learning; the fourth part mainly from the aspects of legislation, law enforcement and judicial relief, etc. Some feasible suggestions on the protection of athletes' labor rights and interests are put forward. The author hopes that through the study of this problem, the author can arouse the attention of all walks of life to the protection of the labor rights of athletes, and can explore a feasible way to ensure that the sports industry can be regulated better. It is helpful to the protection of athletes'labor right.
