劳动法上待命时间的法律问题研究

【摘要】:劳动法上,因待命时间引发的劳动纠纷在全国出现了“井喷”的现状,但由于立法层面法律的缺失,地方立法各不相同,造成法院在认定待命时间是否为工作时间时作出各种不同的判断,这既损害劳动者的合法权益,减损司法权威,也折射出相关理论研究的滞后。在借鉴有关待命时间定性的学理基础上,对工作时间问题重新做了一次研究,并结合法院在司法案件中的对待命时间问题具体情况的认定及判决,最终得出待命时间符合工作时间要求,应当定性为工作时间的结论。在具体的待命时间认定过程中,将实际案件中常见的待命时间具体展开为监视性待命时间、侯传性待命时间、附随性待命时间这三种类型进行讨论。通过具体案例的整理和分析,尝试探讨出各类待命时间可行的工资支付方式和法律规制方法。囿于司法实务中各种待命时间的劳动者受控程度不同,因而有关工作时间归属的标准和判断依据也不能一概而论。故本文根据每一种待命时间的不同特点,仔细剖析其劳动法理的精神,并结合司法判例,对每一类待命时间的认定问题分别提出自己的初步思路。
[Abstract]:In the labor law, labor disputes caused by standby time have appeared the status quo of "blowout" in the whole country. However, due to the lack of laws at the legislative level, local legislation is different. As a result, the court makes all kinds of different judgments when determining whether the standby time is working time, which not only damages the legitimate rights and interests of workers, detracts from judicial authority, but also reflects the lag of relevant theoretical research. On the basis of reference to the doctrine of the qualitative nature of standby time, a new study has been made on the question of working time, and combined with the determination and judgement of the court's treatment of the question of life time in judicial cases, Finally, the conclusion that standby time meets the working time requirement should be defined as working time. In the process of identifying the specific standby time, the common standby time in actual cases is divided into three types: surveillance standby time, transmit standby time and accompanying standby time. Through the analysis of specific cases, this paper tries to explore the feasible wage payment methods and legal regulation methods of all kinds of standby time. Due to the different degree of control of all kinds of standby time in judicial practice, the standard and judgment basis of working time attribution can not be generalized either. Therefore, according to the different characteristics of each kind of standby time, this paper carefully analyzes the spirit of its labor law, and combining with judicial precedent, puts forward its own preliminary thinking on the determination of each kind of standby time.
