【摘要】:随着我国市场经济的发展,雇佣雇员为个人或组织劳动服务,变得越来越频繁,在劳动力市场化的今天,具有劳动能力的个体基本上都处于一个雇佣的链条关系中,由此,雇主责任问题是与我们每一个人的日常生活息息相关的。在现代社会,雇主责任有两方面的含义:一是雇主对雇员在从事雇佣活动过程中致他人损害所应承担的责任,二是雇主对雇员在从事雇佣活动中自身损害所应承担的责任。第一种含义是侵权行为法研究的范畴,第二种含义往往是在劳动法中加以规制。所以,雇主责任法律制度,涉及民法和劳动法等各部门法,内容庞杂,然而我国与之相关的成文法律条文不多,这既给目前我国司法实践对相关责任的认定带来了困难和混乱,也使得对雇主责任的研究有了广阔的空间和前景。正基于此,本文从雇主责任概念的界定入手,对雇主责任的发展简史进行了考察,其后对雇主责任的理论基础进行了论述,并结合我国立法与司法现状及存在的问题与不足,对我国构建与完善雇主责任制度提出了相应的立法建议。全文共分四个部分: 第一部分:雇主责任概述。这部分首先介绍了雇主责任的定义,界定了本文的研究对象。对于雇主责任的发展简史进行了考察,分析了雇主责任的发展趋势。接下来,通过雇主责任的理论基础推导其归责原则和法理学渊源,对受益说、监督过失说、深口袋说、公共政策说、法经济分析说等进行了评析,并指出了各种理论基础的不足之处和自己的见解,为下文的展开垫定理论基石。 第二部分:我国现有雇主责任立法评析。本部分首先对我国目前立法中涉及的雇主责任法律规定进行了梳理和分类,在此基础上,指出了我国目前立法中存在的不足之处,分析了现行规范中存在的问题,由此,有针对性的引导下文的立法完善,为接下来论述如何构建我国的雇主责任制度勾勒出框架。 第三部分:我国雇主责任的立法完善。本部分针对我国目前的社会经济发展形势并充分权衡各方面的利益,提出了如何进一步完善我国雇主责任制度立法及建立相关配套法律的建议。 第四部分:对本课题的研究进行了展望,并指出了本论文研究中存在的不足。
[Abstract]:With the development of market economy in our country, it becomes more and more frequent to employ employees for personal or organizational labor service. In today's labor market, individuals with labor ability are basically in a chain of employment, so, The problem of employer responsibility is closely related to the daily life of each of us. In modern society, the employer's liability has two meanings: the first is the employer's responsibility for the damage caused by the employee in the course of the employment activity, and the second is the employer's responsibility for the employee's own injury in the employment activity. The first kind of meaning is the category of tort law research, the second kind of meaning is often regulated in the labor law. Therefore, the legal system of employer's liability, involving civil law and labor law and other departments, contains a lot of miscellaneous contents. However, there are few written legal provisions related to it in our country, which has brought difficulties and confusion to the determination of relevant responsibilities in the current judicial practice of our country. It also makes the research of employer liability have broad space and prospect. Based on this, this paper begins with the definition of employer's liability, investigates the development history of employer's liability, then discusses the theoretical basis of employer's liability, and combines the present situation of legislation and judicature of our country and the existing problems and deficiencies. This paper puts forward the corresponding legislative suggestions to construct and perfect the employer's liability system in our country. The full text is divided into four parts: Part I: Overview of employer's liability. This part first introduces the definition of employer liability and defines the object of this paper. The development history of employer's liability is reviewed, and the development trend of employer's liability is analyzed. Then, through the theoretical basis of employer liability, the author deduces the principle of imputation and the origin of jurisprudence, and evaluates the theory of benefit, the theory of supervisory negligence, the theory of deep pocket, the theory of public policy, the theory of legal and economic analysis, etc. It also points out the deficiencies of various theoretical bases and their own opinions, which lays the theoretical foundation for the following development. The second part: the analysis of the existing employer liability legislation in China. This part firstly combs and classifies the legal provisions of employer's liability involved in the current legislation of our country, on this basis, points out the deficiencies in the current legislation of our country, analyzes the existing problems in the current norms, and thus, Guide the legislative perfection of the following, and outline the framework of how to construct the employer liability system in our country. The third part: our country employer liability legislation consummation. In view of the current situation of social and economic development in China and weighing the interests of all aspects, this part puts forward some suggestions on how to further improve the legislation of employer liability system and establish relevant supporting laws. The fourth part: the prospect of this research, and pointed out the shortcomings of this paper.
