【摘要】: 劳动合同是用人单位和劳动者签订的有关劳动权利和劳动义务的协议。劳动合同是一种特殊的合同,它的订立、变更、解除和终止对劳动合同当事人的利益影响重大。实践中,大多有关劳动合同争议案件的发生都是由单方解除劳动合同引起的,这是由于劳动合同双方对法律规定的理解不一致,以及劳动合同解除立法上的缺陷,导致了用人单位和劳动者滥用合同解除权的现象时有发生,严重损害了劳动合同当事人的利益,同时也不利于劳动关系的稳定。 本文运用比较分析的方法,分四个部分对劳动合同单方解除制度进行了较为全面系统地分析与研究。第一部分探讨了劳动合同单方解除的法律原理,先对劳动合同解除的概念及特征进行了分析,然后通过劳动合同单方解除与相关概念的比较,对劳动合同单方解除的内涵有了一个更加清楚的认识。第二、三部分分别从用人单位单方解除劳动合同和劳动者单方解除劳动合同两个方面,对劳动合同单方解除的法律规制作了研究。然后从比较法的角度,对国内外有关劳动合同单方解除立法进行了分析和比较。最后,结合2006年3月全国人大常委会办公厅全文公布的《中华人民共和国劳动合同法(草案)》(下称《劳动合同法(草案)》) ,指出了《劳动法》和《〈劳动合同法(草案)》关于我国劳动合同单方解除权制度的立法现状及存在问题,并提出了自己的看法和建议,希望对我国劳动立法的完善有所裨益。
[Abstract]:Labor contract is the agreement between employer and laborer about labor right and labor obligation. Labor contract is a kind of special contract. Its conclusion, modification, dissolution and termination have great influence on the interests of the parties to the labor contract. In practice, most of the disputes about labor contract are caused by unilateral termination of labor contract, which is due to the inconsistent understanding of the legal provisions between the two sides of the labor contract, as well as the defects in the legislation on the termination of the labor contract. It leads to the abuse of the right to rescind the contract by the employer and the laborer, which seriously damages the interests of the parties to the labor contract and is not conducive to the stability of the labor relations. In this paper, the method of comparative analysis is used to analyze and study the system of unilateral rescission of labor contract in four parts. The first part discusses the legal principle of unilateral termination of labor contract, first analyzes the concept and characteristics of the termination of labor contract, and then compares the unilateral termination of labor contract with related concepts. There is a clearer understanding of the connotation of unilateral termination of labor contract. Second, the third part studies the legal regulation of unilateral termination of labor contract from two aspects: unilateral termination of labor contract by employer and unilateral rescission of labor contract by laborer. Then from the angle of comparative law, this paper analyzes and compares the legislation of unilateral rescission of labor contract at home and abroad. Finally, in the light of the draft Labor contract Law of the people's Republic of China (hereinafter referred to as the Labor contract Law (draft) published in March 2006 by the General Office of the standing Committee of the National people's Congress, This paper points out the present legislative situation and existing problems of the system of unilateral rescission of labor contract in China, and puts forward its own views and suggestions, hoping to be of benefit to the perfection of labor legislation in China.
