劳动规章制度的效力探析

【摘要】:用人单位劳动规章制度作为协调劳动关系的有效规则,对于建立和维护单位内部秩序,明确劳动关系双方权利与义务,促进劳动关系的和谐稳定具有重要意义。合法有效的规章制度对于用人单位及全体劳动者均具有约束力,然而用人单位制定劳动规章制度的正当性何在?劳动规章制度的效力究竟来源于何处?其生效要件如何?如何对其效力进行认定?目前学界对这些问题的回答莫衷一是,理论上的研究不够系统,专著甚少;我国劳动立法对上述问题的规定也不够明确和全面,使得在处理劳动争议案件的司法实践中缺乏明确统一的依据,往往造成司法判决的不一致。笔者正是基于以上考虑,在总结前面学者研究成果的基础上,借鉴发达国家和地区对于该制度的立法和实践经验,采用理论联系实际和比较分析的方法,试图对劳动规章制度效力领域的有关问题进行较为全面的探析。 本文共分为引言、正文、结语三大部分,其中正文包括四章。 第一章是用人单位制定劳动规章制度的正当性分析。本章首先界定并分析了劳动规章制度与相关概念;然后从用人单位的权利义务与企业实现经营自主权的需要两个角度阐释了用人单位制定规章制度的正当性。 第二章探究了劳动规章制度的效力来源。本章首先介绍了目前学界关于劳动规章制度效力来源的主流学说,而后逐一分析了各种学说,指出笔者更倾向于格式条款说,即认为劳动规章制度作为劳动合同的附件,或称为格式条款,其效力来源于劳动合同,最后阐述了笔者支持该学说的几点理由。 第三章概括了劳动规章制度的效力表现。本章首先从对人效力,空间效力和时间效力三个方面对劳动规章制度的效力范围作了说明;然后对劳动规章制度、劳动合同和集体合同三者间的效力层级作了分析。 第四章是劳动规章制度效力的认定。在前几章对劳动规章制度的效力来源、效力范围、效力层级的论述基础之上,本章重点探讨了其生效要件及其效力规制。首先介绍分析了外国典型劳动立法的有关规定,在此基础上重点探讨了我国劳动规章制度应具备的生效要件,即制定主体适格,内容合法、合理,程序合法。其中笔者用大量笔墨分析了劳动规章制定程序中的决定程序究竟为“单决模式”还是“共决模式”。然后对如何规制劳动规章制度的效力作了尝试性的探讨。
[Abstract]:The labor rules and regulations of employing units are effective rules for coordinating labor relations. It is of great significance to establish and maintain internal order in units, to clear the rights and obligations of both parties in labor relations and to promote the harmony and stability of labor relations. What is the legitimacy of the labor rules and regulations? Where does the effectiveness of the labor rules and regulations come from? How do they take effect? How to determine their effectiveness? At present, the answers to these questions are quite different from those in the academic circles. The theoretical research is not systematic and the monographs are scarce; the provisions of our labor legislation on the above problems are not clear enough. And overall, the lack of a clear and unified basis for judicial practice in dealing with labor disputes often causes disagreement of judicial decisions. Based on the above considerations, the author, on the basis of summarizing the research results of the previous scholars, draws on the legislative and practical experience of the developed countries and regions for the system, and adopts the theory to connect with the reality and the practice. The method of comparative analysis tries to conduct a more comprehensive analysis of the relevant issues in the field of effectiveness of labor rules and regulations.
This article is divided into three parts, the introduction, the main body and the conclusion. The body contains four chapters.
The first chapter is the analysis of the legitimacy of the labor rules and regulations formulated by the employer. Firstly, this chapter defines and analyzes the labor rules and regulations and related concepts, and then explains the legitimacy of the enacted rules and regulations of the Employer from two angles of the rights and obligations of the employer and the needs of the enterprise to realize the management autonomy.
The second chapter explores the source of the effectiveness of the labor rules and regulations. This chapter first introduces the mainstream theory of the source of the effectiveness of the labor rules and regulations, and then analyzes the various theories, and points out that the author is more inclined to form terms, that is, the labor rules and regulations are attached to the labor contract, or form terms, and their effectiveness. It comes from the labor contract, and finally expounds several reasons why the author supports this theory.
The third chapter summarizes the effectiveness of labor rules and regulations. This chapter first illustrates the effectiveness of labor rules and regulations from three aspects of human effectiveness, space effectiveness and time effectiveness, and then analyses the effectiveness level of labor rules and regulations, labor contracts and collective contracts between the three parties.
The fourth chapter is the identification of the effectiveness of labor rules and regulations. In the first few chapters, on the basis of the effectiveness of the labor rules and regulations, the scope of effectiveness and the level of effectiveness, this chapter focuses on its effective requirements and its effectiveness regulation. First, it introduces and analyzes the relevant provisions of the foreign typical labor legislation, and on this basis focuses on the study of China's labor. The effective elements of the rules and regulations, that is, make the main body fit, the content is legitimate, reasonable and the procedure is legal. The author uses a large number of ink and ink to analyze whether the decision procedure in the labor rules and regulations is "single decision mode" or "common pattern". Then, the author tries to discuss how to regulate the effectiveness of labor rules and regulations.
