农民工劳动就业权法律保护问题初步研究

【摘要】: 自上世纪80年代始,随着改革开放的深入和工业化城市化进程的加快,大量农村剩余劳动力进城务工,他们的户籍身份是农民,却从事着非农劳动,并以此为主要生活来源,这就形成了我国社会的一个特殊群体——城市农民工。我国正处于社会转型时期,有些制度还不完善,存在着一些问题。农民工这一特殊时期的特殊群体,在现有制度下,自身的权益缺乏应有的保障,其中劳动就业权就受到了很多侵害。 本文所研究的就是农民工平等就业权和侵害农民工劳动就业权的法律责任问题。文章共分三个部分。第一部分是农民工概述,介绍了农民工的形成过程,特点,就业状况。第二部分分析了现有法律保护农民工在就业中不受歧视方面存在的问题,以及侵害劳动就业权的法律责任的不足。第三部分相应提出了一些立法建议。平等就业权方面:1.清除职业保留法规,加强对歧视性法规、规章和文件的清理。2.实施农民工前劳动力市场歧视损失的财政补偿措施。3.改革现行户籍制度。4.尽快制定《反歧视法》。5.建立“平等就业机会委员会”或者类似机构。法律责任方面:加重侵害农民工劳动就业权的法律责任,变现有的单一的经济责任为多层次多种类的“立体化”责任。
[Abstract]:Since the 1980s, with the deepening of the reform and opening up and the acceleration of the process of industrialization and urbanization, a large number of rural surplus labor force has entered the city to work, their household registration status is a farmer, but they are engaged in non-agricultural labor, and this is the main source of life. This formed a special group in our society-urban migrant workers. China is in the period of social transformation, some systems are not perfect, there are some problems. Under the existing system, the rights and interests of the migrant workers in this special period of the special group, lack of due protection, among which the right to employment has been a lot of violations. This paper studies the equal employment right of migrant workers and the legal responsibility of infringing on migrant workers' right to employment. The article is divided into three parts. The first part is an overview of migrant workers, introduced the formation of migrant workers, characteristics, employment situation. The second part analyzes the problems existing in existing laws to protect migrant workers from discrimination in employment, as well as the insufficiency of legal liability for infringing the right to employment. The third part puts forward some legislative suggestions accordingly. Equal right to employment: 1. Remove career retention regulations and strengthen cleanup of discriminatory laws, regulations and documents. Implement the financial compensation measures of discrimination loss in the labor market of migrant workers. 3. 3. Reform of the current household registration system. Enact the Anti-Discrimination Law as soon as possible. Establishment of Equal Employment opportunity Commission or similar bodies. Legal liability: aggravating the legal responsibility of infringing the labor and employment rights of migrant workers, changing the existing single economic responsibility into a multi-level and multi-type "three-dimensional" responsibility.
