论大学生校外兼职期间的劳动法保护

【摘要】:大学生在校外从事兼职工作已然遍及社会各个角落,校外兼职大部分是学生的自觉性行为,目前处于放任无序的状况。随着兼职大学生队伍的不断壮大,出现了许多损害大学生权益的现象,主要表现为无故延长工时、克扣薪资等。多数大学生表示权益受损后维权困难,只能自认倒霉。究其原因,是学校未将大学生校外兼职纳入教育管理范围内,政府管理部门监管不严,大学生自身法律意识淡薄等。但最重要的原因是理论界和实务界对大学生的身份认定未形成共鸣,法律法规也并未对相关概念和法律关系做出具体界定,这种大学生私自在校外打工行为目前正处于一个“三不管”的境地。文章阐述了大学生在校外私自打工过程中面临的各种侵害行为,透过现象看本质,深刻讨论了造成此种现象的具体成因,提出现行的首要任务是明确界定大学生校外兼职的理论概念,同时理清与用人单位的法律关系性质,明确提出对大学生兼职行为应分开讨论,不可统一而论。逐步完善法律法规,规范各个社会主体的法律责任,积极调动高校、用人单位、社会的力量共同保障大学生的合法权益,鼓励大学生加强自我防范意识,协调好兼职与学习的关系,运用法律的手段进行维权。
[Abstract]:College students engaged in part-time work outside the school has spread all over the society, the majority of part-time outside the school is the conscious behavior of students, at present in a state of laissez-faire disorder. With the development of part-time college students, there are many phenomena that damage the rights and interests of college students, such as prolonging working hours for no reason, withholding wages and so on. Most college students said that rights and interests after the rights and interests of the difficulties, can only admit bad luck. The reason is that the university does not bring the part-time work of college students into the scope of education management, the government administration department is not strict, the university students' own legal consciousness is weak and so on. However, the most important reason is that the theoretical and practical circles have not resonated with the identification of college students, and the relevant concepts and legal relations have not been specifically defined by laws and regulations. This kind of college student private work outside school behavior is currently in a "three regardless" situation. This paper expounds all kinds of encroachment behaviors that college students are facing in the process of off-campus self-employment, and discusses the causes of the phenomenon through the essence of the phenomenon. The first task is to clearly define the theoretical concept of university students' part-time work outside school, at the same time to clarify the nature of the legal relationship with employers, and clearly put forward that the part-time activities of college students should be discussed separately, which cannot be unified. Gradually improve laws and regulations, standardize the legal responsibilities of various social subjects, actively mobilize the forces of universities, employers, and society to jointly protect the legitimate rights and interests of college students, and encourage college students to strengthen their sense of self-prevention. Coordinate the relationship between part-time and study, use legal means to protect rights.
