论劳动者精神性人格权的法律保护

【摘要】: 劳动者精神性人格权是劳动者最基本的民事权利,它是劳动者实现人格独立、维护人格尊严的重要条件,也是享有和实现财产权等其他民事权利的前提。其涵义是指劳动者在劳动关系建立及存续过程中,应当享有公平、安全、无伤害的工作环境及人格尊严不受侵犯的权利。本文首先介绍了劳动者精神性人格权的内涵、特征及类型,进而对劳动者精神性人格权产生的背景与正当性基础进行了阐述,最后深入分析了我国劳动者精神性人格权保护制度的不足,并针对不足提出对我国劳动者精神性人格权立法如何完善的总体构想。人格权包括精神性人格权和物质性人格权,本文主要围绕劳动者精神性人格权进行探讨。 “徒法不足以自行”,任何权利只有在被接受为公众意识的时候,才能真正被实现。培育重视人格权益的文化,提倡对劳动者人格自由、人格独立、人格尊严的尊重,对于劳动者精神性人格权的实现具有不容忽视的作用。同时为了维护人的价值、尊严和安全,法律应该不断加强对劳动者精神性人格权的法律保护,不断完善劳动者精神性人格权保护的法律体系。
[Abstract]:The workers' spiritual personality right is the most basic civil right of the laborer. It is the important condition for the laborers to realize the independence of personality and to maintain the human dignity, and is also the premise to enjoy and realize other civil rights such as property rights. Its meaning is that workers should enjoy the right of fair, safe, unharmed working environment and inviolable human dignity in the process of establishing and surviving labor relations. This paper first introduces the connotation, characteristics and types of the workers' spiritual personality right, and then expounds the background and legitimate foundation of the laborer's spiritual personality right. Finally, it analyzes the deficiency of the protection system of the workers' spiritual personality right in our country, and puts forward the overall idea of how to perfect the legislation of the laborer's spiritual personality right in view of the deficiency. The right of personality includes the right of spiritual personality and the right of material personality. This article mainly discusses the right of spiritual personality of laborer. "the law of apostasy is not enough for oneself", and any right can be realized only when it is accepted as public consciousness. Cultivating a culture of attaching importance to the rights and interests of personality and advocating respect for the freedom, independence and dignity of the personality of the laborer plays an important role in the realization of the right to spiritual personality of the laborer. At the same time, in order to maintain the value, dignity and safety of human beings, the law should constantly strengthen the legal protection of workers' spiritual personality rights, and constantly improve the legal system of the protection of workers' spiritual personality rights.
