企业惩戒法律制度研究

【摘要】:2008年《企业职工奖惩条例》废止,劳动法却未对企业惩戒有所规定。企业惩戒制度虽保障企业的正常生产经营秩序,但其必然关系到雇员的直接利益是否减损。立法上的空白使得企业恣意惩戒的风险激增,所以,构建符合中国国情的企业惩戒法律制度,成为了劳动法体系建设中亟待解决的问题。通过对理论学说的总结,认为企业惩戒的核心是通过对员工可归责的错误行为进行惩戒,达到平衡劳资双方利益,维持劳动关系的稳定的目的。因为企业惩戒具有限制功能、稳定功能、教育功能,它已成为企业管理和调整劳动关系的重要手段。企业惩戒制度的内容包括事由、措施、程序、监督救济,通过比较企业惩戒制度与相关制度,得出企业惩戒制度具有独立性的结论。然而,通过对我国企业惩戒法律制度的立法状况的梳理,发现除惩戒性解雇外,现行劳动法体系中再无关于企业惩戒的相关规定,针对当前我国企业惩戒立法空白的现状,总结我国企业惩戒法律制度建设所要面临的问题,包括实体规范缺失、程序管控不严、监督救济不力三个方面。因此,我们有必要借鉴域外先进的立法和司法实践经验,指导我国企业惩戒法律制度建设。大陆法系国家中的德、日、法三国于成文法领域内,在企业惩戒的内容、程序、监督方面走在世界的前列;英美法系国家中的美、英两国于判例法领域内,通过司法实践形成的对企业惩戒的内容、程序、争议处理的规定也遥遥领先其他国家;这都值得我国在企业惩戒模式选择、利益取向、程序规制、监督救济等方面取长补短。最后,本文针对我国企业惩戒法律制度创设面临的实体、程序、监督救济方面的问题,提出针对性的完善措施。包括:实体内容上,明确惩戒原则,惩戒事由坚持以劳动者义务为准,惩戒措施建立层级分明的体系;程序方面,建立并完善设立和实施程序,保证程序对于企业惩戒的有效规制;监督救济方面,从行政、司法、工会三方面入手建立全过程的监督与救济体系。
[Abstract]:In 2008, the regulations on reward and punishment of Enterprise employees were abolished, but the Labor Law did not provide for corporate discipline. Although the enterprise discipline system guarantees the normal production and operation order of the enterprise, it must relate to the direct benefit of the employee. The gap in legislation makes the risk of arbitrary punishment of enterprises surge sharply. Therefore, the construction of enterprise disciplinary legal system in accordance with China's national conditions has become an urgent problem to be solved in the construction of labor law system. By summing up the theory, the author holds that the core of corporate discipline is to balance the interests of both employers and employees and to maintain the stability of labor relations by punishing the employees' mistakes that can be attributed to them. Because of its restrictive function, stable function and educational function, corporate discipline has become an important means of enterprise management and adjustment of labor relations. The content of the enterprise disciplinary system includes subject matter, measures, procedures, supervision and relief. By comparing the enterprise disciplinary system with the related system, the conclusion that the enterprise disciplinary system is independent is obtained. However, by combing the legislative situation of the legal system of corporate discipline in our country, we find that, besides disciplinary dismissal, the current labor law system has nothing to do with the relevant provisions of corporate discipline, aiming at the current situation of blank legislation on corporate discipline in our country. This paper summarizes the problems faced in the construction of the legal system of corporate discipline in China, including the lack of substantive norms, the lack of strict control of procedures, and the lack of supervision and relief. Therefore, it is necessary for us to draw lessons from the foreign advanced legislative and judicial practice experience to guide the construction of China's enterprise disciplinary legal system. Germany, Japan and France are in the forefront of the world in terms of the content, procedure, and supervision of corporate discipline in the field of statutory law, and the United States and Britain in common law countries are in the field of case law. Through the judicial practice of the content of corporate discipline, procedures, dispute handling provisions are also far ahead of other countries; this is worthy of our country in the choice of corporate discipline mode, interest orientation, procedural regulation, supervision relief and other aspects to learn from each other. Finally, aiming at the problems of entity, procedure, supervision and relief in the legal system of corporate discipline in China, this paper puts forward some measures to improve it. Including: substantive content, clear discipline principles, disciplinary reasons adhere to the obligations of workers, disciplinary measures to establish a hierarchical system; procedures, establish and improve the establishment and implementation of procedures, In the aspect of supervision and relief, the supervision and relief system of the whole process is established from three aspects: administration, judicature and trade union.
