用人单位规章制度的法律性质探讨

【摘要】:用人单位的规章制度与劳动合同、集体合同分别采取不同的方式,从不同的层面调整劳动关系双方的权利与义务。由于对规章制度的性质存在理论上的不同认识,这种争议伴随着《劳动合同法》,在规章制度有关理论和实务方面存在多种理解和操作。 本文包括引言、正文和结语等五个部分。每个部分的主要内容如下: 引言部分首先分别介绍与规章制度有关的劳动规章制度、劳动纪律、劳动合同、集体合同等概念,以及其中的关联和异同。由于《劳动合同法》立法过程中缺乏有关规章制度的明确的理论指导,导致有关规章制度的法律规定非常含糊,事实上,《劳动合同法》出台后,地方立法和地方司法界出现了有关规章制度的不同甚至相互矛盾的规定,这些均源于对于用人单位规章制度的法律性质缺乏准确定位。 第一章主要是有关规章制度法律性质的相关学说,分别对纯粹契约说、事实上习惯说、劳动合同附件说、经营权说、习惯法说、授权说、根据二分说、集体合意说进行介绍和评析。 第二章在上一章对各类学说评析的基础上,根据规章制度的产生和规制劳动关系的角度,认为规章制度的法律性质应当为“有条件法律规范说”,规章制度应当按照一定的条件分为具有法律规范性质的规章制度和不具有法律规范性质的规章制度。具有法律规范性质的规章制度的条件为民主的制定程序、公示、内容的不违法,在处理规章制度与劳动合同、集体合同的关系时,应当按照有利于劳动者的原则适用。不具有法律规范性质的规章制度劳动者也应遵守,遵守的义务相当于职业道德范畴。在这一章,也用大量的篇幅对比了有条件法律规范说与其他学说的异同,尤其是对于其他学说不能解释的问题,从有条件法律规范说的角度进行了阐释。 第三章通过介绍外国有关规章制度的立法情况,分别对制定规章制度的义务应与用人单位用工人数有关系、制定权与制定程序、内容、公示、行政备案审查以及规章制度与劳动合同集体合同关系的角度进行介绍和分析,提出了部分建议,且从中也可以变相佐证笔者的有关思路。 结语部分则总结和强调了本文的主要观点,希望能够对于有关规章制度的理论研究和立法起到抛砖引玉的一点作用。
[Abstract]:The rules and regulations of the employer, the labor contract and the collective contract respectively adopt different ways to adjust the rights and obligations of both sides of labor relations from different levels. Due to the different understanding of the nature of the rules and regulations, this dispute is accompanied by "Labor contract Law", there are a variety of theoretical and practical aspects of the rules and regulations understanding and operation. This paper includes five parts: introduction, text and conclusion. The main contents of each part are as follows: the introduction first introduces the concepts of labor rules and regulations, labor discipline, labor contract, collective contract and so on, as well as their relevance and similarities and differences. Due to the lack of clear theoretical guidance on the rules and regulations in the legislative process of the Labor contract Law, the legal provisions on the rules and regulations are very vague. In fact, after the promulgation of the Labor contract Law, The local legislation and local judicial circles have different or even contradictory regulations about the rules and regulations, all of which are due to the lack of accurate orientation for the legal nature of the rules and regulations of the employing unit. The first chapter is mainly about the relevant theories about the legal nature of the rules and regulations, respectively, to the pure contract, in fact, to the custom, to the attachment to the labor contract, to the right of operation, to the customary law, to the authorization, according to the dichotomy, The theory of collective agreement is introduced and evaluated. On the basis of the analysis of various theories in the previous chapter, the second chapter considers that the legal nature of the rules and regulations should be "conditional legal norm theory" according to the emergence of rules and regulations and the angle of regulating labor relations. The rules and regulations shall be classified according to certain conditions into rules and regulations with the nature of legal norms and rules and regulations without the nature of legal norms. The conditions of rules and regulations with the nature of legal norms are democratic formulation procedures, publicity and non-illegal contents. When dealing with the relationship between rules and regulations, labor contracts and collective contracts, the rules and regulations shall be applied in accordance with the principles in favour of workers. Rules and regulations that do not have the nature of legal norms should also be observed, the obligation to comply with the scope of professional ethics. In this chapter, we also compare the similarities and differences between the conditional legal norm theory and other theories, especially for the other theories can not be interpreted, from the point of view of conditional legal norms theory. Chapter III, by introducing the legislation of the relevant rules and regulations of foreign countries, respectively, the obligation to formulate the rules and regulations should be related to the number of employees employed by the employing unit, the right to formulate the rules and procedures, the content and the publicity, This paper introduces and analyzes the relationship between the administrative record examination and the rules and regulations and the collective contract of labor contract, and puts forward some suggestions, which can also be used to prove the author's thinking. The conclusion summarizes and emphasizes the main views of this paper, hoping to play a role in the theoretical research and legislation of the relevant rules and regulations.
