论我国最低工资制度的完善

【摘要】:最低工资制度是调整劳动关系中的分配制度,确保公平对待弱势群体中弱势劳动者的保护措施。我国自1993年实施了最低工资制度,而实行最低工资制度是我国在参考国际经验中采取的一项新的工资政策。在当前形势下,最低工资制度作为我国劳动关系法律体系中的重要组成部分,体现了法律的对人权的价值诉求和构建和谐社会的需要。最低工资制度的建立与完善,旨在保障劳动者的基本生活与发展权益,从公民的基本权利方面体现的法律对人权的关注,同时也是和谐社会形成与发展的基础。虽然我国的最低工资制度发展至今进步明显,以《最低工资规定》为代表的制度设计与以往相比更具有可操作性,更有效地保障了劳动者的合法权益。然而现如今我国的最低工资制度仍存在许多不足,以待改进。从法律制度自身角度看,需要在立法等级、制度规范性、适用范围等方面进行提升。最低工资制度的核心是最低工资标准的确定与调整,通过分析在我国现阶段最低工资标准条件下所表现的问题,结合相关的劳动经济学与劳动社会学理论,可以在标准的制定与调整措施、相关程序的变革等方面寻求突破;特别是针对我国目前最低工资标准过低的情况,来通过各种措施对其进行提升。同时,最低工资制度执行过程中的相关问题十分突出,需要通过加强执法力度、提高宣传水平、完善监督职能等途径来促使最低工资制度健康和谐的发展。其可以避免劳动者虽然提供了正常劳动却不能维持劳动力生产和再生产的问题。最低工资制度的本质是政府为了改善低技能劳动力的收入状况而对劳动力市场进行干预的一种手段,其实质是通过强制性的立法把低技能劳动力的工资提高到这些劳动力的市场均衡工资之上,以此手段来实现某种社会公平。
[Abstract]:The minimum wage system is a protective measure to adjust the distribution system in labor relations and ensure fair treatment of vulnerable workers in vulnerable groups. China has implemented the minimum wage system since 1993, and the implementation of the minimum wage system is a new wage policy adopted by our country in reference to international experience. Under the current situation, the minimum wage system, as an important part of the legal system of labor relations in China, embodies the value demand of the law for human rights and the need for building a harmonious society. The establishment and perfection of the minimum wage system is aimed at protecting the basic life and development rights of the laborer, paying attention to the human rights from the basic rights of the citizens, and also the foundation of the formation and development of a harmonious society. Although the development of the minimum wage system in China has made remarkable progress so far, the system design represented by the "minimum wage regulations" is more operable and more effective in protecting the legitimate rights and interests of workers than in the past. However, China's minimum wage system still has many shortcomings, to be improved. From the point of view of the legal system, it needs to be upgraded in the aspects of legislative level, system standardization, application scope, and so on. The core of the minimum wage system is the determination and adjustment of the minimum wage standard. We can find a breakthrough in the establishment and adjustment of standards and the reform of relevant procedures; especially in view of the situation that the minimum wage is too low in our country at present, we can upgrade it through various measures. At the same time, the relevant problems in the implementation of the minimum wage system are very prominent. It is necessary to promote the healthy and harmonious development of the minimum wage system by strengthening the law enforcement, improving the propaganda level and perfecting the supervisory function. It can avoid the problem that workers can not maintain labor force production and reproduction although they provide normal labor. The essence of the minimum wage system is a means of government intervention in the labour market in order to improve the income of low-skilled workers. Its essence is to raise the wage of low-skilled labor to the market equilibrium wage of these labors through compulsory legislation, and to realize some social equity by means of this method.
