中国建筑企业拖欠工资现象及其对策研究

【摘要】:分析中国建筑企业拖欠工资现象及其对策研究 农民工是当代中国出现的一种特殊社会现象,长期以来,施工企业拖欠农民工工资现象普遍存在,农民工成为当代中国权益最受到损害的弱势群体,拖欠农民工工资不仅严重损害了农民工的合法权益,而且也影响了社会的稳定、和谐和发展。本文从现状调查入手,研究施工企业拖欠农民工工资的原因,在此基础上提出相应对策。先对农民工工资的拖欠现状进行了选样调查分析,分析了农民工工资拖欠的特点,以及拖欠农民工工资严重危害,包括对农民工本人及家庭的影响。造成施工企业拖欠农民工工资有多方面的原因,从农民工劳务市场供求和施工企业与劳务提供者不完全信息静态博弈经济学的角度进行了分析,紧接在宏观层面和微观层面对拖欠原因进行了分析,既有建设单位拖欠工程款造成的连锁反应,更有施工企业劳务分包及用工管理的混乱,还有施工企业资金紧张造成劳务分包费的拖欠。同时,就解决农民工工资的拖欠提出相应对策,包括通过改变劳动力供求失衡的局面和建立农民工工资的法律保障体系,在微观层面本文从施工企业的角度提出了相关解决对策,包括采取措施避免建设单位拖欠工程款,加强劳务分包管理,推行农民工身份实名制管理,强化资金内部控制与管理等措施解决企业资金紧张状况。 同时,解决建设领域拖欠工程款和农民工工资问题,涉及到政府和社会各方力量相互协调配合,仍需进一步完善相关的法律法规体系,全面加强对工程建设项目的立项、建设程序的审批、企业信用平台的管理,建立完善现代企业工资支付监控制度以及建立农民工法律援助制度。
[Abstract]:An Analysis of the phenomenon of arrears of wages in Chinese Construction Enterprises and its Countermeasures; migrant workers are a special social phenomenon in contemporary China. For a long time, the phenomenon of arrears of wages of migrant workers in construction enterprises has been widespread. Migrant workers have become the most vulnerable group whose rights and interests have been most damaged in contemporary China. Arrears in wages of migrant workers not only seriously damage the legitimate rights and interests of migrant workers, but also affect the stability, harmony and development of society. Starting with the investigation of the present situation, this paper studies the reasons of the construction enterprises defaulting on the wages of migrant workers, and puts forward the corresponding countermeasures on this basis. Firstly, this paper makes an investigation and analysis on the status quo of migrant workers' salary arrears, and analyzes the characteristics of migrant workers' salary arrears, as well as the serious harm to migrant workers' wages, including the impact on migrant workers themselves and their families. There are many reasons that cause construction enterprises to default on migrant workers' wages. This paper analyzes the supply and demand of migrant workers' labor market and the static game economics of incomplete information between construction enterprises and labor providers. Immediately at the macro and micro levels, the reasons for the default are analyzed. There is a chain reaction caused by the construction units defaulting on the project payment, and the confusion of labor subcontracting and labor management in construction enterprises. Still have construction enterprise capital is tight cause the arrears of labor subcontract fee. At the same time, it puts forward corresponding countermeasures to solve the arrears of migrant workers' wages, including changing the imbalance of labor supply and demand and establishing a legal guarantee system for migrant workers' wages. At the micro level, this paper puts forward the relevant countermeasures from the angle of construction enterprises, including taking measures to avoid the construction units from defaulting on project funds, strengthening the management of labor subcontracting, and carrying out the management of the real name system of migrant workers' identity. Strengthen the internal control and management of funds and other measures to solve the shortage of enterprise funds. At the same time, to solve the problem of arrears in construction payments and migrant workers' wages, which involves the coordination and coordination between the government and various social forces, it is still necessary to further improve the relevant laws and regulations system and comprehensively strengthen the establishment of projects for construction projects. The examination and approval of construction procedure, the management of enterprise credit platform, the establishment of modern enterprise wage payment monitoring system and the establishment of legal aid system for migrant workers.
