论我国劳动争议仲裁制度的重构
[Abstract]:The arbitration system of labor dispute is the core system to deal with labor dispute in our country. The establishment of this system is to resolve the labor dispute in a peaceful atmosphere in a timely and fair manner and to safeguard the legitimate rights and interests of both sides of labor relations. However, with the rapid development of economy, the number of labor dispute cases is increasing rapidly and becoming more and more complicated. Based on the data analysis of the current labor dispute arbitration system in China, this paper summarizes that the filtering effect of labor dispute arbitration procedure is not obvious by using the methods of literature research, empirical research and comparative study. The labor dispute arbitration institution has administrative color and the standard of arbitrators is on the low side, the proportion of labor dispute arbitration cases is high, the procedure of handling interest dispute cases is single, and the procedure setting of the final arbitration is limited. There are some defects in the supervision system of labor dispute arbitration. Through drawing lessons from the experience of foreign labor dispute arbitration system, this paper analyzes the necessity and feasibility of reconstructing the current labor dispute arbitration system in our country, and proposes to realize the independence of labor arbitration institution and improve the standard of arbitrators' appointment. According to the different types of labor disputes, we should carry out different processing procedures; replace the existing system of labor dispute arbitration with the classification system; give the final nature of the arbitration award of labor dispute, and implement a final ruling; Supervise the labor dispute arbitration and guarantee the justice and authority of the labor dispute arbitration.
