行政权力规制与劳动关系自由化的互补与双赢

【摘要】: 我国改革开放以后经济环境的蓬勃发展,各种经济主体在追求发展的过程中,因专注效益增长而忽略了劳资关系的稳健和谐。《劳动合同法》的适时出台,是我国劳动关系新的里程碑。本文将自行政机关执法、监督暨劳雇双方利益调和角度出发,探讨《劳动合同法》出台后,利益关系各方应有的作为。 第一章从华为员工自愿离职事件,剖析《劳动合同法》实施后企业面临的主要挑战及促进合同法有效实施的关键。《劳动合同法》规定,在一定条件之下,用人单位需接受劳方签订无固定期合同的要求,虽然该法立法目的不在保障铁饭碗,但因经济补偿责任,将影响企业内人才的良性流动,造成人力资源制度的僵化,不利于企业永续发展。华为公司是我国具有全球知名度的企业,冒然采取“买断工龄1、重签合同”方式来应对《劳动合同法》的要求,除影响企业本身的形象外,对社会也起到负面的示范作用。另,这样的作法是否确实能够达成公司所预期的目标?本文将从该公司策略方案的角度与法律规定的内涵,分析《劳动合同法》立法实践所面临的挑战。 第二章劳动者基本生活及工作权的保障,是国家的宪法责任,而企业主应在国家承担基本义务之后履行补充责任。福利国家制度的实施,必须根据国家的经济发展情况采取有步骤的推进。我国正处于经济起飞阶段,法律制度的设计有必要保护经济上的弱者,但激励经济发展、保障全民,更是宪法的精神。因此,立法或执法的平衡,需审慎评估,避免伤害企业的活力。 劳动合同是劳雇双方合意而签订的双务合同。双方平等协商是契约自由原则的具体实践。劳动关系中存在资强劳弱的现实,若贯彻契约自由,可能导致用人单位假自由之名而侵害了劳动者的权益。基于劳动关系的社会性特质,国家公权力应适度的平衡当事人双方的利益,而调整缔约自由。本文拟从劳动合同关系的特质,探索劳动合同自由的限制,同时探索行政权力规制的有效方法。 第三章劳动保障的执法监督与司法救济。《劳动合同法》的实施,重点在于法治理念的强化与执法、维权制度的落实。各种经济组织在建立制度、规章的过程中,必需受到劳动保障监察机关的管理与监督。行政部门除完善各项监督法规外,应加强监督人才的培训与技术能力的提高,并对各企业的相关执行人员纳入法制意识的培训体系中,同时加强劳动者教育,把各种违规、脱法行为防范于形成之前。在争议事件发生的善后方面,则从制度面提供合理公平的争议处理机制,包括争议的调解、仲裁以及诉讼。 劳动关系的行政诉讼应有之意,在督促行政机关合法行政,其宗旨在稳健与和谐,与民事诉讼并无不同。本文基于劳动关系速审、速结之需要,对司法救济制度提出改革建议。 第四章劳动立法完善的过程中,国际经验的借鉴足以调整过程中的弊病。德、法二国在经济发展上曾独领风骚,劳动保护制度立法,则迟滞了国家的经济发展。但该二国为已开发国家,人民生活水平已达一定的高度,提高劳动者保护基点,是迈向福利国家的必要过程。 我国经过多年的实证检验,计划经济体制已无法满足现代化经济发展的潮流。改革开放以来,建立中国特有的社会主义市场经济体制,使国民生产能力提升、民众生活水平提高,实现了我中华民族数千年来努力追求的小康社会。然而,经济发展造成的贫富差距,又造成新的贵族阶层,剥削基层劳动者的情况时有所闻。政府行政权力必需介入调整,以提升劳动者的经济地位。同时督促企业以社会责任的承担,在实践可持续发展的努力中,落实和谐劳动关系,奠定立法、执法与适法者多赢格局,使我国由小康社会迈入全面富足。 第五章“结语”。《劳动合同法》的实施,为我国市场经济发展提供了转辙器。在经济发展中与劳动者共享成长的果实,是每一个企业家必须有的愿景。企业社会责任的实践,是企业存在的核心价值;劳动者则努力创造人力资本效益。《劳动合同法》的立法宗旨与目标在为企业创造好的经营环境,为劳动者塑造安身立命的成长空间。在互惠互利的法治环境之中,实践社会利益相关者的多赢局面。
[Abstract]:After the vigorous development of the economic environment after China's reform and opening up, all kinds of economic subjects have ignored the steady and harmonious labor relations in the process of pursuing the development. The timely introduction of labor contract law is a new milestone in the labor relations of China. This article will be taken from the administrative organs, supervision and employment of both parties. Starting from the introduction of the labor contract law, the parties concerned should do what they should do.
