对我国职工流动法律规制之反思

【摘要】:现行劳动法对劳动者的流动作了较为宽松的规定,但其实施效果对劳资双方都不利,利益博弈下,劳动者利益受损害的可能性更大。因此,对劳动者进行适当分层,然后根据其特点需求,对劳资双方的劳动力产权予以承认并进行模糊界定,作出有针对性的立法调整。
[Abstract]:The current labor law makes a relatively loose regulation on the flow of workers, but the effect of its implementation is unfavourable to both labor and capital. Under the interest game, the workers' interests are more likely to be damaged. Therefore, a proper stratification of the workers is carried out, and the property rights of the labor and capital are recognized and defined in a fuzzy way according to their characteristics. Make targeted legislative adjustments.
