《劳动合同法》实施后劳动派遣的若干法律问题研究

【摘要】: 随着社会经济的发展,劳动派遣被越来越多的单位采用,在劳动派遣中,劳动者的“雇佣”和“使用”相分离是最大特征,即派遣劳动者与派遣单位签订劳动合同,却在要派单位的指挥监督下工作。 劳动派遣是一种新型的劳动法律关系,涉及到派遣单位、要派单位和派遣劳动者三方当事人。由于《劳动合同法》实施前各地方政府将劳动派遣作为扩大就业的方式加以鼓励,各地方性法规不健全,我国派遣劳动者权益保护存在差别待遇、雇主责任落实难度加大等诸多问题。 2007年6月,我国颁布了《劳动合同法》,出于规范劳动派遣,保护派遣劳动者的权利以及维护标准劳动关系的需要,该法对劳动派遣作了统一的规定。与以往的地方性法规相比,该法确定了劳动派遣由登录型与雇佣型并存转变为单一的雇佣型派遣,提高了派遣单位的注册资本,加强了对派遣劳动者权利的保护等等。 《劳动合同法》实施后,劳动派遣实践中仍有许多问题没有得到妥善的解决,如派遣机构的设立、劳动派遣的期限与范围、雇主责任的分担等,另外,还产生了一些新的问题,如劳动派遣的转型问题、同工同酬的实现问题、雇主责任承担方式的问题等。因此,我国应在对日本、美国、德国、台湾地区等有关劳动派遣制度借鉴的同时,根据我国的具体情况从派遣机构的设立、劳动派遣期限与范围、劳动派遣合同的解除与经济补偿、雇主责任的分担、保护派遣劳动者的平等权等方面进行劳动派遣的制度设计,从而有效地保护派遣劳动者的合法权利,充分发挥劳动派遣的积极作用。
[Abstract]:With the development of social economy, the labor dispatch is used by more and more units. In the labor dispatch, the separation of "employment" and "use" is the biggest characteristic, that is, the dispatch worker and the dispatch unit sign the labor contract. He works under the command and supervision of the unit. Labor dispatch is a new kind of labor law relation, involving dispatch unit, sending unit and dispatching laborer tripartite parties. Before the implementation of the Labor contract Law, the local governments encouraged the dispatch of labor as a way to expand employment, and the local laws and regulations were not perfect, so there were differences in the protection of the rights and interests of dispatched workers in our country. In June 2007, China promulgated the Labor contract Law to regulate labor dispatch, to protect the rights of dispatched workers and to maintain the standard labor relations. The law makes a uniform provision for the dispatch of labor. Compared with the previous local laws and regulations, the law determines that the labor dispatch changes from logon type and employment type to single employment type dispatch, and improves the registered capital of the dispatch unit. After the implementation of the Labor contract Law, there are still many problems in the practice of labor dispatch that have not been properly resolved, such as the establishment of dispatch agencies. In addition, some new problems have arisen, such as the transformation of labor dispatch, the realization of equal pay for work of equal value, the way of the employer's responsibility, and so on. Therefore, while drawing lessons from the relevant labor dispatch systems in Japan, the United States, Germany and Taiwan, China should, according to the specific conditions of our country, consider the establishment of dispatch agencies, the duration and scope of labor dispatch. The cancellation of labor dispatch contract and economic compensation, the sharing of employer's responsibility, the protection of the equal rights of dispatched workers, and so on, are designed to effectively protect the legitimate rights of dispatched workers. Give full play to the positive role of labor dispatch.
