试析市场经济条件下企业职业培训的法律完善

【摘要】：人，是生产力诸要素中最活跃的因素。本文结合我国目前的实际情况，借鉴国外有效的经验，论述了国有企业走向市场的竞争，关键是人才的竞争，，而职工教育必然成为一个很重要的竞争手段。为贯彻执行我国《宪法》、《劳动法》有关职业培训的规定，引导劳动者进一步注重学习和培训，提高自身职业素质，增加劳动者的就业机会，提高他们的竞争能力、适应能力和经济收入，更好地促进我国职业技术培训工作的展开，本文从劳动立法的角度作了三个方面的阐述：１、加大培训力度，改革教育结构和培训制度，加强注重对高等职业教育的立法；２、全面实行职业技能鉴定和职业资格证书制度；３、实施劳动预备制度
[Abstract]:Man is the most active factor in all factors of productive forces. Based on the actual situation of our country and the effective experience of foreign countries, this paper discusses the competition of state-owned enterprises towards the market, the key is the competition of talents, and the education of workers and staff is bound to become a very important means of competition. In order to carry out the provisions of the Constitution and the Labor Law on vocational training, to guide workers to pay more attention to study and training, to improve their professional quality, to increase their employment opportunities, and to enhance their competitiveness, In order to better promote the development of vocational and technical training in China, this paper expounds three aspects from the angle of labor legislation: 1. Strengthen training, reform educational structure and training system. Strengthening the legislation of higher vocational education; (2) to implement the system of vocational skill appraisal and vocational qualification certificate in an all-round way; and (3) to implement the labor preparation system
