劳动保障监察“两网化”建设调研报告

【摘要】:改革开放以来,随着公共所有制企业改制的不断推进、私营企业的发展壮大及劳动者维权意识的不断增强,劳动保障监察面临更多的挑战。如何进一步创新监管手段和方式,优化劳动保障监察执法水平,提升办案效率,最大程度地促进劳动保障法律法规得到贯彻落实,切实维护劳动者权益,是新形势下劳动保障监察工作面临的新课题。2009年开始,政府审时度势,开展劳动保障监察“两网化”的探索和建设。劳动保障监察信息系统的设立,满足了劳动保障监察快速处理案件、落实科学监管、风险预防和宏观决策等要求,较好地解决了劳动保障监察监管被动缺位、案件处理效率不高等问题,帮助劳动保障监察单位实现了对监管对象的动态化、信息化、全面化监管,为规范用人单位遵守劳动保障管理制度、及时追究各种违法行为提供了很大便利。本文以长沙地区基层劳动保障监察状况入手,探讨劳动保障监察“两网化”建设的时代背景和地域背景,以及制度实施对劳动保障监察工作带来的影响,并根据调查结果提出针对性的建议。基层劳动保障监察“两网化”建设,实现了劳动保障监察信息系统与空间信息系统相链接,能够使劳动监管机关实时直观地掌握最新动态以及用人单位等违反劳动保障法律法规行为的情况,加大了侵害劳动者权益行为的查处力度。劳动保障监察空间信息系统的创建,实现了劳动保障监察工作手段和工具的创新,借助计算机等工具加强劳动保障监察力度,实时采集网格区域内用人单位用工、劳动合同签订、社会保险购买、工资按时支付、工作安全条件等信息,实施动态监控,建立起严密的监控体系,全覆盖、全过程监督检查的新型劳动保障监察机制,及时掌控用人单位用工信息,实现科学分类、动态监管,预防和有效查处各类劳动侵权违法行为,自推行以来取得了良好的社会效果。但同时,劳动保障监察领域“以罚代管”依旧盛行,基层执法力量薄弱、财政投入不足,劳动保障监察手段、制度亟待创新等依旧制约着劳动保障监察“两网化”建设的步伐。
[Abstract]:Since the reform and opening up, with the continuous promotion of the reform of the public ownership enterprises, the development and expansion of private enterprises and the continuous strengthening of workers' awareness of protecting their rights, labor security supervision is facing more challenges. How to further innovate the means and methods of supervision, optimize the level of labor security supervision and law enforcement, improve the efficiency of handling cases, maximize the implementation of labor security laws and regulations, and earnestly safeguard the rights and interests of workers, It is a new task that the labor security supervision work faces under the new situation. Since 2009, the government has reviewed the situation and carried out the exploration and construction of the "two networks" of the labor security supervision. The establishment of labor security supervision information system satisfies the demands of labor security supervision to deal with cases quickly, implement scientific supervision, risk prevention and macro decision-making, and solve the passive absence of labor security supervision and supervision. The inefficient handling of cases has helped the labor security supervision units to realize the dynamic, informational and comprehensive supervision of the objects of supervision, in order to standardize the employers' compliance with the labor security management system. Prompt investigation of various illegal acts has provided great convenience. Starting with the situation of labor security supervision at the grass-roots level in Changsha, this paper probes into the background of the construction of "two networks" of labor security supervision and the regional background, as well as the influence of the implementation of the system on the work of labor security supervision. And according to the results of the investigation put forward targeted recommendations. The construction of "two networks" for grass-roots labor security supervision has realized the link between the labor security supervision information system and the spatial information system. It can make the labor supervision authorities grasp the latest trends and the situation of violating labor security laws and regulations in real time, and increase the investigation and punishment of violations of workers' rights and interests. The establishment of the labor security supervision spatial information system has realized the innovation of the labor security supervision work means and tools, strengthened the labor security supervision by means of computer and other tools, and collected the employing units in the grid area in real time. The signing of labor contracts, the purchase of social insurance, the timely payment of wages, the working safety conditions, and other information, the implementation of dynamic monitoring, the establishment of a strict monitoring system, the full coverage, the whole process of supervision and inspection of a new type of labor security supervision mechanism, It has achieved good social effect since it was implemented by controlling the employment information of the employing unit in time, realizing scientific classification, dynamic supervision, preventing and effectively investigating and punishing all kinds of illegal labor infringement. But at the same time, the field of labor security supervision is still popular, the basic law enforcement force is weak, the financial input is insufficient, the labor security supervision means, the system needs to be innovated and so on, which still restricts the construction of the labor security supervision "two nets".
