中国赴日劳工权益保护研究
[Abstract]:Since the beginning of the 21st century, with the globalization of the economy, China's foreign economic and trade have flourished, and the number of Chinese workers going to various countries to work has increased rapidly. According to data from China's Ministry of Commerce, by the end of 2010, The total number of foreign labor workers in China is 847000, and the total number of all kinds of labor workers dispatched by our country has reached 5.43 million. In recent years, with the increasing number of workers going to work in foreign countries in China, all kinds of problems have followed, among which the protection of labor rights and interests has attracted more and more attention. The rights and interests of Chinese workers engaged in various industries abroad are infringed from time to time, and the number of infringements has increased sharply, which has aroused the great concern of our government and society. The problems faced by overseas Chinese workers are mainly about property disputes, but there are also disputes about personal safety and working environment. However, as the problems generally arise in the work of workers, The concealment of employment units and workers themselves is difficult to be found by society and the media because of the concealment of various reasons. As a result, such violations of Chinese workers' rights abroad are far less striking than the heavy casualties caused by frequent attacks on large Chinese institutions. This also makes the related research relatively backward. As a neighboring country of China, Japan is one of the Asian countries that receive the most Chinese labor, and one of the main places where Chinese labor rights are frequently infringed. All kinds of disputes of Chinese labor in Japanese enterprises are complicated in nature and have the particularity of Japanese labor service. Therefore, when solving these problems, we should take into account the local laws of Japan and put forward corresponding solutions to the specific problems. This paper studies the protection of Chinese labor rights and interests in Japan by way of investigation and research. This article starts with the current situation and function of labor service to Japan. In this paper, the problems of labor rights protection in Japan are analyzed. Finally, in view of these problems, put forward the corresponding solution. It is hoped that the publication of this paper will play an important role in drawing the attention of scholars and people to the disadvantaged group of Chinese labor in Japan.
