派遣劳动者致人损害的用人单位责任——对《侵权责任法》第34条第2款的检讨

【摘要】:对派遣劳动者致人损害的赔偿责任,《侵权责任法》第34条第2款的规定不尽合理:一是赔偿责任主体,无论根据私法上的雇主责任理论,还是劳动法上的劳务派遣制度,均应将派遣单位与用工单位界定为共同的责任主体;二是归责原则,派遣单位与用工单位构成共同的用人单位,应统一适用无过错责任原则;三是责任形态,派遣单位应与用工单位承担连带赔偿责任。
[Abstract]:Article 34, paragraph 2, of the Tort liability Law provides that the liability for damages caused by dispatched workers is not entirely reasonable: first, the subject of compensation liability, whether according to the theory of employer's liability in private law or the system of labor dispatch in labor law, Should define the sending unit and the employment unit as the common responsibility subject; Second, the principle of imputation, the dispatch unit and the employment unit constitute the common employing unit, should apply the principle of no-fault liability uniformly; third, the responsibility form, the dispatch unit should bear the joint and several liability with the employment unit.
