我国劳动者病假保障制度的问题及完善

【摘要】:当前我国劳动者病假保障制度存在的问题主要包括病假期限计算不合理、病假工资负担主体不妥当、病假工资金额设定不科学、病假期内劳动者社会保险费负担太沉重以及用人单位支付医疗补助费无依据等五个方面。为了切实保障劳动者的合法权益,合理调整政府、用人单位和劳动者三方关系,立法有必要重新设定病假期限及计算方式、合理界定病假工资在社会保障部门和用人单位之间的负担、按照效率与公平原则科学确定病假工资金额、适当减免病假期内劳动者负担的社会保险费,彻底废除用人单位支付医疗补助费的规定。
[Abstract]:The problems existing in our country's sick leave protection system mainly include unreasonable calculation of sick leave period, improper main body of sick leave pay burden, and unscientific setting of sick leave salary amount. Sick leave laborer social insurance premium burden is too heavy and employer pays medical subsidy fee without basis and so on five aspects. In order to effectively protect the legitimate rights and interests of workers and rationally adjust the tripartite relationship between the government, the employing unit and the laborer, it is necessary to re-set the period of sick leave and the mode of calculation by legislation. Reasonable definition of the burden of sick leave pay between social security departments and employers, scientific determination of the amount of sick leave pay in accordance with the principle of efficiency and equity, and appropriate reduction of social insurance premiums borne by workers during sick leave, Completely abrogate the stipulation that unit of choose and employ persons pays medical subsidy fee.
