以实现和谐的人事关系为目标 努力完善我国人事争议仲裁制度

【摘要】:从1995年人事部正式提出建立人事争议仲裁制度,到2003年最高人民法院发布《关于人民法院审理事业单位人事争议案件若干问题的规定》,经过十多年的发展,我国人事争议仲裁制度框架体系已得到了初步确立,并实现了与司法制度的接轨。进入新世纪新阶段,党中央提出了构建社会主义和谐社会、人才强国等一系列战略目标,要求妥善协调各方面的利益关系,正确处理人民内部矛盾。中共中央、国务院《关于进一步加强人才工作的决定》也明确提出要“完善人事争议仲裁制度”。今年正式实施的《公务员法》首次以国家法律的形式, 提出了“国家建立人事争议仲裁制度”,进一步明确了人事争议仲裁制度的法律地位。这些都为完善人事争议仲裁制度指明了方
[Abstract]:From the official proposal by the Ministry of personnel in 1995 to establish an arbitration system for personnel disputes, to the issuance in 2003 by the Supreme people's Court of provisions on certain issues concerning the trial of personnel disputes in Public institutions by the people's Court, after more than ten years of development, Our country personnel dispute arbitration system frame system has been established preliminarily, and has realized the connection with the judicial system. Entering a new stage in the new century, the CPC Central Committee has put forward a series of strategic objectives, such as building a socialist harmonious society, strengthening the country with talents, and so on, requiring proper coordination of the interests of all sides, and correct handling of the contradictions among the people. The decision of the CPC Central Committee and the State Council to further strengthen the work of personnel also explicitly proposes to "perfect the arbitration system of personnel disputes." The Civil Service Law, which was formally implemented this year, for the first time in the form of national law, put forward the "Establishment of personnel dispute Arbitration system by the State", which further clarified the legal status of the personnel dispute Arbitration system. All of these points out the way to perfect the arbitration system of personnel dispute.
