简论同时履行的判决

【摘要】：同时履行抗辩权是《合同法》中的一项实体性权利,基于双务合同中功能上的牵连性而存在。但有一个现实问题:当事人一方提起诉讼时对方以同时履行抗辩权来抗辩,且抗辩权成立的情况下,法院该如何判决?这就涉及到同时履行的判决。同时履行的判决在我国大陆尚属新问题,我国无明文规定,属法律空白点。文章欲通过简要剖析同时履行判决的有关内容,以达到弥补民事程序法与实体法脱节的目的。
