我国消费者无理由退货权的解释论

【摘要】:我国《消费者权益保护法》第25条规定的无理由退货权,在性质上是法定的无理由解除权,其正当性基础在于保障消费者的意思形成自由;该权利适用的交易方式是上门推销和远程交易,适用的交易对象是商品和服务;该权利一经行使,消费者合同即告解除,尚未履行的,终止履行,已经履行的,双方互相返还;消费者合同解除后,与之关联的其他合同也随之消灭。
[Abstract]:The right to return goods without reason as stipulated in Article 25 of the Consumer Rights and interests Protection Law of our country is the legal right to rescind goods without reason in nature, and its legitimacy is based on the protection of the freedom of the consumer's will formation. The right applies in the form of door-to-door marketing and remote trading, and applies to goods and services; As soon as this right is exercised, the consumer contract shall be dissolved, if not yet performed, the performance shall be terminated, and where the performance has been fulfilled, the two parties shall return to each other; After the termination of the consumer contract, the associated other contracts are also eliminated.
