论我国成年监护制度的不足和完善

【摘要】：成年监护制度设立的目的在于保护成年精神障碍者的人身、财产和其他合法的权益。此制度通过弥补障碍者行为能力,使其民事权利得到充分实现。成年监护制度所具有的制度价值使其受到各国的重视。目前,德、日、法、美等主要大陆法系国家制定了比较完善的成年监护制度。但我国成年监护制度发展较晚,立法贫瘠、且不便于操作。随着社会老龄化加剧和精神病人口增加,原有的成年监护制度已经无法满足社会需求,难以发挥其制度的真正作用。本文在结合外国成功立法经验和我国实际情况的基础上上,对我国成年监护制度改革提出完善建议。
