老字号的法律保护问题研究

【摘要】：我国悠久的历史孕育了很多具有特色,享誉国内外的老字号。老字号并不是只有“老”而己,他所代表的是一种信赖与习惯,是品质的保证,是传统的坚持,所以才能永续经营,历久不衰。老字号的传统风味长存人们心中,是很多人小时候的记忆,具有独特的人文价值和魅力。然而,随着市场经济的不断发展,老字号的发展也遭遇了一系列的挑战。历史文化传统的束缚,经济社会变迁的冲击,保护老字号的法律制度的不完善,都使侵害老字号合法权利的事件在国内外频发,老字号的发展面临种种困难,老字号的现状令人堪忧。本文主要关注于老字号的法律保护的不足与完善。本文从老字号被侵权事件频发的现状出发,分别从立法、行政、司法这三个层面,通过与境内外国家相关法律制度的比较,分析得出我国目前保护老字号法律的不足。我国不仅没有保护老字号的专门法,也缺乏对字号权的相关规定；在行政方面,我国现存的字号登记制度存在诸多缺陷,政府也未给予老字号有力的支持；司法方面也存在诸多不足。这都阻碍了老字号的健康发展,使老字号的维权之路困难重重。本文对我国的老字号法律保护制度的完善作了初步的探讨,也相应地分别从立法、行政、司法的角度给出自己的建议。本文主张颁布保护老字号的专门法,完善对老字号字号权的规定,建立保护老字号的完善的法律体系。建议政府设立统一老字号专门管理机构,对老字号的发展给予政策支持。同时,在司法实践中给予老字号保护。老字号法律保护制度的完善对于老字号的保护具有重大的意义,不仅可以保护老字号权利人的合法权利,也可以保障我国的社会主义市场经济秩序。
[Abstract]:The long history of our country has given birth to many famous domestic and foreign famous brands. The old brands are not only "old" but themselves. What he represents is a kind of trust and habit, a guarantee of quality and a traditional persistence. The traditional flavor of the old brand is in people's minds, it is the memory of many people as a child and has unique humanistic value and charm. However, with the continuous development of the market economy, The development of old brands has also encountered a series of challenges. The shackles of historical and cultural traditions, the impact of economic and social changes, and the imperfection of the legal system for the protection of old brands have made the incidents of infringing upon the legal rights of old brands frequent at home and abroad. The development of the old brand faces all kinds of difficulties, the current situation of the old brand is worrying. This article mainly focuses on the insufficiency and perfection of the legal protection of the old brand. Through the comparison with the domestic and foreign countries' relevant legal system, the author draws the conclusion that there is not only no special law to protect the old brands, but also no relevant provisions on the rights of the old ones in our country. In the administrative aspect, there are many defects in our country's existing trademark registration system, and the government has not given enough support to the old ones, and there are also many deficiencies in the administration of justice. All these have hindered the healthy development of the old brands. This paper makes a preliminary discussion on the perfection of the legal protection system of the old brands in our country, and correspondingly, separately from the legislative, administrative, This paper proposes to promulgate the special law to protect the old brands, to perfect the regulations on the rights of the old ones, to establish a perfect legal system to protect the old ones, and to suggest that the government should set up a special administrative agency for the old brands.
